Licensing Program Analyst (LPA) Jyoti Saini met with director Rebecca Martinez for an unannounced Annual Random Inspection. LPA disclosed the purpose of the inspection and was granted entry into the facility by the director. In addition to the director, 25 children, and five (5) staff members are present today. The facility operates Monday - Friday from 7:30 am to 6:00 pm in rooms #1 and #2 on the St. Leander school campus. The facility was inspected indoors and outdoors today for health and safety hazards, and the following was observed:
There is a working fire alarm system in the facility. The facility has a working smoke and carbon monoxide detector, a fully charged fire extinguisher, and a working telephone. During today's inspection, no bodies of water, firearms, or weapons are on the premises. The Center is in good condition with proper temperature and ventilation, and is free of hazards. All furniture is in good repair. The Center has age-appropriate toys and equipment in both classes, and a first aid kit and a first aid backpack are available. The playground has been closed due to structural issues with the play structure since 03/08/2022. The school is in the process of running fundraising to help fix the play structure. The facility has set up a little play area with rubber padding near room #2, consisting of a small seesaw, a small slide, a small house, and a small climbing structure. LPA inspected the structure during the inspection and found it free of hazards. LPA reminded the facility representative to provide 100% care and supervision during outdoor playtime. The facility has a waiver that allows the Center to share the bathrooms with St. Leander school's students, and a waiver is posted at a prominent place. The children bring their water bottles, and the facility refills bottles using water fountains as needed. Each child has a separate cot and bedding. The bedding is sent home weekly to be washed by the parents. Children bring their lunch from home, and the facility provides snacks. LPA reviewed storage of food and reminded director that all food must be in original packaging or labeled with expiration date. The last Emergency Drill was conducted on 2/16/2024 at 10:30 am and is properly logged. The Center has a complete record of sign-in/out sheets by an authorized pick-up person. All the Children's files contained wrong licensing forms ( see attached LIC 9102 technical violation)

 During the inspection, LPA printed and provided all the required forms for the children's files to the director, Rebecca Martinez. The opening and closing teachers have a current Pediatric First Aid/CPR certificate on file. The director understands that at least one person with valid CPR and First Aid certifications shall always be on-site or present during off-site activities (field trips). Two staff members do not have a Mandated Reporter training certificate ( see attached LIC9102 technical violation). The facility roster was reviewed, and a copy was obtained.
During inspection,

Criminal Record Clearance -Facility representative was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

Lead Testing – CCC COMPLETED TESTING


Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for
drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test.
LPA verified that the lead testing was completed in accordance to the Written Directives outlined in PIN 21-21.1-CCP.

Facility representative was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain childcare by connecting them to childcare providers and Resource and Referral Agencies (R&Rs) throughout California.

Type A deficiency is cited today( Please see attached LIC809-D) and six (6) technical violations were given.



LICENSEE MUST POST ANY TYPE A DEFICIENCIES DURING TODAYS VISIT WITH THE NOTICE AND LICENSEE UNDERSTANDS THE NOTICE AND TYPE A DEFICIENCIES MUST REMAIN POSTED FOR THIRTY DAYS. REQUIREMENTS FOR AB 633 FACT SHEET AND A COPY OF ACKNOWLEDGEMENT OF RECEIPT OF LICENSING REPORTS (LIC 9224) WERE DISCUSSED WITH PROVIDER. PROVIDER UNDERSTANDS THIS REQUIREMENT.

Appeal rights were given.

A notice of site visit was given and must remain posted for 30 days.

Exit interview conducted and report was reviewed with the director, Rebecca Martinez.
