On 8/27/2021 at 3:00pm, Licensing Program Analysts (LPAs) Jaylena Miller and Briana Plumboy arrived at Celebration Learning Center for the purpose of a plan of correction inspection. LPAs were greeted by the Office Administrator as they stepped out of the vehicles. On 8/12/21, LPA Jaylena Miller conducted a complaint inspection and as a result cited the center a TYPE A violation due to non compliance of mask wearing indoors during the COVID-19 pandemic. The Department of Public Health mandated mask wearing indoors for childcare during this time. LPAs inspected the the school age program classroom #4 first. Present in classroom #4 was S1 who was not wearing a mask indoors and 12 children. Nine out of the 12 children present in room #4 were not wearing masks. At 3:05pm, LPAs inspected, observed, and conducted a physical census of the preschool classroom (Facility #013415193). Present for the inspection were 6 napping preschoolers as well as 3 staff, S2 and S3 were not wearing masks indoors, and staff S4 was observed to be wearing a mask. At 3:10pm S5 arrived in a school van from picking up school-age children. At 3:30pm Director Julie Jensen arrived from picking up school age children and came to speak with LPAs. LPAs explained the purpose of the visit to the Director and the Director stated LPAs needed to speak to P1 and P2 because the issue was above her. Director stated that it is their religious belief not to wear mask and that all the parents of both programs were in agreement with their decision. Director also stated she was authorized from P1 and P2 not to receive any documents from licensing and would not be signing the report, receiving the report, or having an exit interview conducted. At 3:40pm, LPAs counted 30 school age children total and 5 staff members. Appeal rights left at the center at the office door. A notice of site visit was left at center at the office door and must remain posted for 30 days.

Director will notify all staff and parents that mask are required while indoors immediately. Director will post Guidance for the Use of Masks by the CA Dept. of Public Health for all parents and staff by 8/30/2021.

Based on observations and interviews the faciity does not require staff or children to wear mask indoors during the COVID-19 mask mandate which poses an immediate risk to the health and safety to children in care.

Today a civil penalty of $250 is being assesed due to a repeat violation of personal rights citied on 8/12/21. $100 per day civil penalty will be assessed until corrected.
