Licensing Program Analyst (LPA) Jyoti Saini arrived unannounced to deliver the findings from a complaint investigation for the above allegation. LPA met with Director Scott Kinser and explained the purpose of the inspection. Present for today's visit, there were director, assistant director and 7 fingerprint-cleared and associated staff members, and 58 children in care.
Based on interviews and record reviews, it was revealed that incidents are reported to parents through incident reports and phone calls. Interviews with parents did not identify any concerns regarding the reporting of incidents. Therefore, Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is deemed UNSUBSTANTIATED.
Notice of site visit was provided and must be posted for thirty days.
Appeal rights were given, and an exit interview was conducted with Director Scott Kinser.

Licensing Program Analyst (LPA) Jyoti Saini arrived unannounced to deliver the findings from a complaint investigation for the above allegation. LPA met with Director Scott Kinser and explained the purpose of the inspection. Present for today's visit, there were director, assistant director and 7 fingerprint-cleared and associated staff members, and 58 children in care.
Based on observations, interviews, and record reviews, the LPA determined that the facility assigned a staff member to the preschool classroom who does not meet the fully qualified criteria under Title 22 regulations, as the staff member is missing required units, which places the facility out of ratio. therefore, the allegation is found to be SUBSTANTIATED. California Code of Regulations, {Title 22, Division 12, Chapter 1, Section 101216.1(b)(1)(A) is being cited on the attached LIC 9099D.

Appeal rights were given and an exit interview was conducted with Director Scott Kinser.
Notice of site visit was provided and must be posted for 30 days.

101216.1 Teacher Qualifications and Duties
(b)Prior to employment, a teacher shall meet the requirements of (b)(1) or (b)(2) below:
(1) A teacher shall have completed, with passing grades, at least six postsecondary semester or equivalent quarter units of the education requirement specified in (c)(1) below, or shall have obtained a Child Development Assistance Permit issued by the California Commission on Teacher Credentialing.(A) After employment, a teacher hired under (b) above shall complete, with passing grades, at least two units each semester or quarter until the education requirement specified in (c)(1) below is met.

The facility shall submit proof of which staff member has been assigned in place of the unqualified staff, along with verification of qualifications. Documentation shall be provided to CCLD by the POC due date. Unqualified staff may only serve as aides and must remain under the direct supervision of a fully qualified teacher.

Based on observations, interviews, and record reviews, the Licensee did not comply with the cited section. The individual assigned to the classroom is lacking the required units to be considered a fully qualified teacher under Title 22 regulations, which poses a potential risk to the health, safety, and personal rights of the children in care.
