Licensing Program Analyst (LPA) Jyoti Saini met with Director Treasa Patterson for a 10-day complaint visit. In addition to the director, 125 children and 16 staff members are present today. During the inspection, LPA inspected the playground and received pertinent documents.
The facility utilizes two outdoor play areas located at the front of the school for children ages 3 to 6. Based on measurements and observations, the fence height is 4 feet at the entrance. However, as you move toward the right side of the facility, the effective fence height decreases to approximately 3 feet. This reduction is due to the accumulation of tanbark and sand, which has raised the ground level and diminished the fence’s measurable height. The preponderance of evidence standard has been met; therefore, the allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12, Chapter 1, Section 101238.2(g) is cited on the attached LIC 9099D.
Appeal rights were given.
A notice of site visit was posted and must remain posted for a period of 30 days.
An exit interview was conducted with Director Treasa Patterson.

The facility shall remove excess ground material and restore the fence to a consistent 4-foot height or install a new fence measuring 4 feet from the ground to meet Title 22 requirements. A follow-up visit will be conducted by the department to ensure the corrective steps have been completed by the POC due date.

Based on observations and record review, the licensee did not comply with the section cited above. LPA determined through measurements that the fence in the preschool outdoor play area does not meet the required four-foot height, which poses a potential health, safety, or personal rights risk to children in care.
