32 | OUTDOOR: LPA Jackson observed the outdoor play area which consist of toys and a play structure with a slide. The infant play area is separated from the preschool play area. There is tan bark all around the play structures that can absorb falls. The outdoor play area is also fenced all around with secured gates. There are no bodies of water on the premises. There are no firearms on premises.
RECORDS: LPA reviewed 6 children’s files and 3 staff files An updated roster was viewed by LPA. A copy was obtained from Director. The Director and staff have completed the Health and Safety training and CPR/First Aid is current. The Director and Staff are following the immunization laws. The staff and Director have not completed the mandated reporter training.

- Type B Violation: Director and staff have not complete required mandated reporter training.
- Type B Violation: Lead Testing was not completed prior to the January 1st, 2023 deadline.
- Technical Violation: Earthquake and Fire Drill not logged.
- Technical Violation: Children's files missing the Physicians report
- Technical Violation: Two outdoor play items are in need of either being removed or renovated to remove potentially hazardous surfaces and items attached.

Director Esquivel was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.
