Licensing Program Analyst (LPA) Jyoti Saini arrived unannounced to deliver the findings from a complaint investigation for the above allegation. LPA met with Director Charlene Sigman and Curriculum Coordinator Lupe Hernandez and explained the purpose of the inspection. The director, Curriculum Coordinator, 27 fingerprint-cleared and associated staff members, and 71 children in care were present for today's visit.
Based on the interviews, observations, and record reviews, it is concluded that the facility also runs an ABA program that provides specialized care, such as speech therapies, Behavioral Health, and Occupational Therapy. Due to the behavioral therapist program, the facility has preschool teachers and RBTs (Registered Behavioral Therapists) associated with each class. Interviews revealed that there were numerous instances where RBTs were left alone in the classrooms and the facility administration was aware of it, which concludes that the facility has unqualified staff. The preponderance of evidence standard has been met; therefore, the allegation is found to be SUBSTANTIATED. California Code of Regulations, {Title 22, Division 12, Chapter 1, Section 101216.1(b)(1) is being cited on the attached LIC 9099D
Appeal rights were given.
A notice of site visit was posted and must remain posted for a period of 30 days.

Based on observations, interviews, and record reviews, the Licensee did not comply with the section cited above. The RBTs who do not have teacher qualifications are left alone in the classrooms which poses a potential risk to the health, safety, and personal rights of the children in care.

LPA met with Director Charlene Sigman and Curriculum Coordinator Lupe Hernandez and explained the purpose of the inspection. The director, Curriculum Coordinator, 27 fingerprint-cleared and associated staff members, and 71 children in care were present for today's visit.
Based on the interviews, observations and record review, LPA has determined that each classroom is adequately staffed to support and supervise the children, which concludes that although the allegation may have happened or is valid, there is no preponderance of evidence to prove the alleged violation did or did not occur. Therefore, the allegation is "Unsubstantiated".

Notice of Site visit and appeal rights were provided.

An exit interview was conducted, and the report was reviewed with the Facility Representatives, Charlene Sigman and Lupe Hernandez.

Licensing Program Analyst (LPA) Jyoti Saini arrived unannounced to deliver the findings from a complaint investigation for the above allegation. LPA met with Director Charlene Sigman and Curriculum Coordinator Lupe Hernandez and explained the purpose of the inspection. The director, Curriculum Coordinator, 27 fingerprint-cleared and associated staff members, and 71 children in care were present for today's visit.
Based on the interviews, observations and record review, LPA discovered an incident was brought to management's attention in which S1 roughly disciplined the child. Furthermore, on 12/19/2023, during circle time, The curriculum coordinator also witnessed S1 using physical force to discipline the child, violating the children's personal rights. which concludes that Facility staff handled day care children in a rough manner. The preponderance of evidence standard has been met; therefore, the allegation is found to be SUBSTANTIATED. California Code of Regulations, {Title 22, Division 12, Chapter 1, Section 101223(a)(1) is being cited on the attached LIC 9099D
