On 06/07/2023 at 09:40 AM Licensing Program Analysts (LPAs) Lorraine Dacanay Breaux and Jaleesa Jackson met with Director, Nicole Custino for a sequent visit to investigate a complaint that was filed against the facility alleging "staff hit day care children". Facility is dual licensed and holds a license for infants (013421389). Present during the visit were thirty-eight (38) preschool age children and seven (7) additional staff.

LPA interviewed director it was determined that the above allegation did indeed occur. As of April 24, 2023, facility terminated staff. LPAs determined the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22 is being cited on the attached LIC 9099D. Failure to submit Proof of Corrections (POC) by Plan of Correction date may result in civil penalties. Facility will notifiy current parents and new families up to 12 months from today's date. Parent's will be provided LIC9224 and the complaint within 24 hours for signature and returned to facility.

A notice of site visit was given to director and must be posted for 30 days. Appeal Rights provided.

POC was that the facility terminated the staff as of April 24, 2023. Director and staff will watch licensing video on Children's personal rights on CCLD website. Each staff will write a statement indicating their understanding of personal rights, and how they will ensure that personal rights of children are always protected. Director will submit to LPA by 06/16/23.Director will notify parents of the incident by June 9th, 2023.

Facility is dual licensed and holds a license for infants (013421389). Present during the visit were thirty-eight (38) preschool age children and seven (7) additional staff.

Based on the interviews and information obtained throughout the investigation, the allegation is unsubstantiated. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is deemed UNSUBSTANTIATED.

This report must remain on file for three years. The facility director was provided a copy of their appeal rights and their signature on this form acknowledges receipt of these rights. Notice of site visit was provided and must be posted for 30 days. Exit interview conducted with director, Nicole Custino.
