25 | On 01/08/2024, Licensing Program Analyst (LPA) Lorraine Dacanay Breaux conducted a Case Management - Lead Testing/Exceedance Inspection. LPA Dacanay Breaux met with Director Blanca Neumann. Also, present during today's visit were six (6) additional staff members and 24 preschool aged children.
The department was notified of a lead exceedance which exceeded the Action Level (ALE) established by the state for lead exposure, elevated lead levels that had exceeded 5.5 ppb . The four (4) outdoor water faucets/hose per director are not in use. Re-testing has been completed and failed. Since the outdoor hose is not used for preparing food and/or drinking the facility will completely cap off the spigots by February 9, 2024. The Lead report was posted on the parent's board as of today and will remain until next testing. Director will notify parents of the lead exposure and forward copy to LPA.
LPA discussed that Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010 to test their drinking water for lead contamination between January 1, 2020 and January 1, 2023, and then every 5 years after the date of the first test. Health and Safety (HSC) Code section 1597.16 authorizes the Department to implement and administer procedures for lead testing at CCCs through written instructions until it adopts regulations under the Administrative Procedure Act.
