Licensing Program Analyst Lisa Dyer met with Director Amber Lamb to provide the results of the above allegation. Present is the director, 1 staff member and 17 preschool children.

LPA investigated the allegation of Inappropriate form of discipline. During the course of the investigation, interviews were conducted. As a form of discipline, a child had been denied snack because they were crying when it was served. Although it was not the staff member's intent, denying snack to a child, while giving it to others is a violation of the child's personal rights. Based interviews which were conducted, the preponderance of evidence standard has been met. Therefore, the above allegation is found to be SUBSTANTIATED. California Code of Regulations, (Title 22, Division 12), is being cited on the attached LIC 9099D,, and must be corrected by the due date. Exit interview conducted. Licensee received a copy of their appeal rights. This report must be kept available for public review for 3 years. Notice of site visit was posted at the time of the inspection and must remain posted for 30 days.

All staff shall view the Personal Rights Video on the Community Care Licensing website. Director shall provide a statement as to how children’s personals rights will not be violated by the facility.

LPA investigated the allegation of Staff call day care children names. During the course of the investigation, interviews were conducted. Staff deny that children were called names. Some children may have been called nicknames, but if they did not like the nickname, teachers did not use it. It cannot be proven or disproven that the allegation did occur.
Although the allegation of Staff call day care children names may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur. LPA investigated the allegation of Staff force children to sit on potty for long periods of time. Interviews were conducted. Staff state that their Potty Training is standard practice for preschool children, and that children were not placed on the potty for long periods of time. Potty training is included in the handbook. Children were too young to be interviewed.
Although the allegation of Staff force children to sit on potty for long periods of time may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur. LPA investigated the allegation of Cleaning solutions are accessible to children. A tour of the facility was conducted. LPA Colson observed a bottle of shampoo, liquid Drano and liquid dish detergent in a closed lower cabinet accessible to children. This was pointed out the director and the items were immediately removed.
Based on observation and interviews which were conducted, the preponderance of evidence standard has been met. Therefore, the above allegation is found to be SUBSTANTIATED. This was pointed out to the director and discussed in detail. Based on observation and interviews which were conducted, the preponderance of evidence standard has been met.
