On December 15, 2022 approximately at 9:00AM Licensing Program Analysts (LPAs) Kelly Phan and Simerjit Kaur met with Assistant Director Ebonee Lucero and Center director Marquita Gladney to deliver findings for the allegations stated above. Present today are 13 infants in two classrooms (Caterpillar and Butterfly) with 5 fingerprinted and associated staff members. LPAs determined that one staff member present today was not cleared after checking in Guardian.

During the course of the investigation, LPA conducted interviews, toured the facility, and review files. It was alleged that the staff are not following day care child's sleep plan and allowed child to cry excessively. It could not be determined if any incident occurred. Although the allegations may have happened or are valid, there are not a preponderance of evidence to prove the alleged violation(s) did or did not occur. Therefore, the allegations are unsubstantiated. A notice of site visit and appeal rights were given. Exit interview conducted and report was review with Marquita Gladney and Ebonee Lucero

Based on observations, interviews and record review, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. SEE LIC 9099D for citation being assessed. Failure to submit Proof of Corrections (POC) by Plan of Correction date may result in additional civil penalties. A notice of site visit and appeal rights were given. Exit interview conducted and report was review with Marquita Gladney and Ebonee Lucero.

POC: Director shall submit a Plan of Correction detailing what has been implemented to ensure the facility is meeting the required teacher-child ratio at all times.

Facility will send teacher qualifications including transcripts to LPA via email or mail by due date of 12/16/2022

Based file review and interviews, the facility did not comply with the section cited above as
3 staff files did not have transcripts and two staff member's units could not be determined that the individuals to be fully qualified, which poses an immediate health, safety or personal rights risk to persons in care.
