On 09/25/2024 at 9:40 AM, Licensing Program Analyst (LPA) Christina Watts and Licensing Program Manager (LPM) Monica Mathur conducted a Case Management inspection at Laura Fierro's large family home. Licensee has requested place backyard on limits. During today's inspection, there were 10 children in care (1 infant and 9 preschool aged children) in care with an aide. Licensee stated she has 10 children enrolled. Licensee and all staff caring for children have Criminal Record Clearance.

LPA and LPM inspected the backyard and observed a fully fenced and safe backyard for children. LPA and LPM observed a high yellow slide that originates from second floor to the bottom of the backyard. The height of slide is unsafe for children in care. Licensee is required to make the bottom of the slide inaccessible. LPA also observed a swing that is mounted from a tree that can hold the weight of an adult. LPA and LPM also observed a swing chair. LPA observed the seat cushions to be ripped in multiple locations. Licensee state they will replace the seat cushion. LPA and LPM observed age appropriate toys for children to play with. LPA and LPM did not observe any bodies of water. LPA and LPM observe cleaning products, plant sprays and sharp gardening tools near the mini garden. Licensee stated the products were there because the backyard was not being used at the time. Licensee stated they will remove the products from the backyard. LPA and LPM also informed the licensee that 100% supervision is required due to the multiple cactus plants observed in the backyard. LPA and LPM informed the licensee that the backyard stairs to the upstairs facility are required to be made inaccessible to children in care.

Also during today's inspection, LPA and LPM observed an assistant who was supervising and caring for children without an association to the facility. As a one time courtesy, LPA associated assistant to facility. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. *CON'T ON PAGE 2*

A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

Prior to placing backyard as an on limit area for facility, licensee has complete the following:

1) Remove all plant sprays, cleaning products and sharp gardening tools from the backyard

2) Make backyard stairs inaccessible to children in care.

3) Replace swing cushions.

4) Made slide inaccessible to children in care.


LICENSEE CANNOT USE BACKYARD UNTIL LICENSING APPROVAL (COMPLETION OF PLAN OF CORRECTION). LICENSEE WILL HAVE UNTIL 10/25/2024 TO SUBMIT REQUIRED DOCUMENTS TO LICENSING. FAILURE TO SUBMIT DOCUMENTS MAY RESULT IN A DELAY OF PLACING BACKYARD ON LIMIT.

During today's inspection, there were no violations observed.

Licensee left facility with children and assistant. Exit interview conducted and report was reviewed with the licensee, Esther Ocampo Rocha. A notice of site visit was given and must remain posted for 30 consecutive days.
