Licensing Program Analyst (LPA) Jyoti Saini met with director Pooja Tiberwal for an unannounced Annual Random Inspection. LPA disclosed the purpose of the inspection and was granted entry into the facility by the director. The Executive Director, Gagandeep Tulsi arrived during the inspection. In addition to the director and Executive director , 62 children and 7 staff members are present today. The facility operates Monday - Friday from 8:30 am to 6:00 pm out of rooms number 1 through 7. The Room #7 is exclusively used for the toddler component ( 18mon-24mon). Currently, the facility is not using Room #1 and Room #2 due to low enrollments. The facility also holds a Heritage license. The Heritage program uses a separate room (Room #8) not licensed by Community Care Licensing (CCL). The licensee understands that the children enrolled in the Heritage program are not to be commingled with children enrolled in childcare licensed by CCL. The facility was inspected indoors and outdoors today for health and safety hazards, and the following was observed.
There are no bodies of water, firearms, or weapons on the premises. The Center is in good condition with proper temperature and ventilation, and is free of any hazards. All furniture is in good repair. The Center has age-appropriate toys and equipment. The bathrooms have age-appropriate faucets and toilets that are in working condition. A first aid kit and a first aid backpack are available. The outdoor play area is fenced for supervision. The children are required to bring their lunch and snacks. The children bring their water bottles, and the facility refills them when needed. Medications are stored on a high shelf, inaccessible to children in care. LPA did not observe any dangerous items that are accessible today. The Center also conducts and documents fire and earthquake drills once every six months, and the logs show that drills were conducted on 5/2024.The center uses an electronic pro-care system to sign in and out the children. There is a working fire alarm system in the facility. The facility has a working smoke and a fully charged fire extinguisher, and a working telephone is available. All the Children's records reviewed were complete. All children have a record of emergency identification information on file. All staff has a criminal record clearance on file. The opening and closing staff have a current Pediatric First Aid/CPR certificate on file. The director understands that there shall always be at least one person with valid CPR and First Aid certifications on-site or present during off-site activities (field trips). The facility roster was reviewed, and a copy was obtained.

(c) To be a fully qualified infant care teacher, a teacher shall have the following: (1) Completion, with passing grades, of 12 postsecondary semester or equivalent quarter units in early childhood or child development education at an accredited or approved college or university. (A) At least three of the units required in (c)(1) above shall be related to the care of infants or shall contain instruction specific to infants.

Based on the observations, interview, and record review, the licensee did not comply with the section cited above. The teacher supervising toddlers in the toddler component is not fully qualified. The teacher does not have the required infant/toddler units, which poses a potential health, safety, or personal rights risk to persons in care.

The facility shall submit proof of enrollment in the infant/toddler development class of the teacher supervising the toddler classroom and request an "exception" for a staff member to remain working in the infant/toddler room while the units are completed or shall arrange fully qualify teacher to work in the toddler room by the due date.

During inspection,

Criminal Record Clearance -

Facility representative was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

Safe Sleep -


LPA discussed the safe sleep regulations with facility representative and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee [or facility representative] of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

CCC COMPLETED TESTING
Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for
drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test.
LPA verified that the the facility is exempt for lead testing in accordance to the Written Directives outlined in PIN 21-21.1-CCP.
