Licensing Program Analyst (LPA) Jyoti Saini arrived unannounced to deliver the findings from a complaint investigation for the above allegation. LPA met with Facility representative Carol Abe and explained the purpose of the inspection. Present for today's visit, there were facility representative , and 3 fingerprint-cleared and associated staff members, and 12 children( 9 preschoolers and 3 toddlers) in care.
Based on the interview, the facility revealed that the food had been prepared using spoiled sauce. Upon discovering the issue, the contaminated food was discarded, and a new batch was prepared. However, interview also revealed that one classroom had already been served the spoiled food, and children had consumed approximately one or two spoonsful therefore, the allegation is found to be SUBSTANTIATED. California Code of Regulations, {Title 22, Division 12, Chapter 1, Section 101227(a)(1) is being cited on the attached LIC 9099D.

Appeal rights were given and an exit interview was conducted with facility representative Carol Abe.

Notice of site visit was provided and must be posted for 30 days.

1012279(a)(1)Food Services (a) In child care centers providing meals to children, the following shall apply:(1)All food shall be safe and of the quality and in the quantity necessary to meet the needs of the children. Each meal shall include, at a minimum, the amount of food components as specified by Title 7, Code of Federal Regulations, Part 226.20, (Revised January 1, 1990) Requirements for Meals, for the age group served. All food shall be selected, stored, prepared and served in a safe and healthful manner.

The facility shall ensure that all food provided to children is prepared only with clean and uncontaminated ingredients. Effective immediately, facility shall complete a daily food-prep checklist before each meal service, and the director will review and sign the checklist weekly to verify compliance. The completed documentation shall be submitted to CCLD for review and approval.

Based on observations, interviews, and record reviews, the Licensee did not comply with the cited section. The food served to the children was prepared using contaminated ingredients, which poses a potential risk to the health, safety, and personal rights of the children in care.
