On 4/30/23 at 3:01pm LPA Mendez conducted a subsequent visit for the purpose of delivering complaint findings. It was alleged that staff handle day care children in a rough manner and staff use inappropriate discipline practices with day care children.
The licensee/administrator was interviewed on 1/13/23 at 2:52pm and stated that staff who treat children in a rough manner would not be working at her facility. Licensee/ administrator stated that staff use redirection, shadowing and have a designated comfy area used as quiet time for children who have behaviors. She stated that they have different agencies that come in and out such as speech, and behavior. Children with any needs receive services. Licensee appointed a new assistant director and a second person in charge who will step in and staff will switch out and they support staff when they need support.
LPA Mendez interviewed three staff (S1-S3) on 1/13/23. LPA Mendez asked staff if they had witnessed staff grabbing children by the arm or shirt and 3 of 3 staff stated no. LPA Mendez asked what is the protocol for staff mistreating children in which 3 of 3 staff stated that it is brought to the attention of licensee LPA Mendez asked S1-S3 how do they discipline children in which 3 of 3 staff stated that they redirect children by giving them different activities.

LPA Mendez interviewed parents (P1-P10) on 1/30/23, 3/7/23, 3/10/23, 3/24/23 and 4/6/23. LPA Mendez asked parents if they had any concerns about their child in care in which 10 of 10 parents stated no. LPA Mendez asked parents if they were familiar with the discipline policy at the center in which 10 of 10 parents stated yes. LPA Mendez asked parents if they knew what the discipline policy was at the center in which 8 of 10 parents stated yes. 6 of 10 parents stated that staff redirect children.

LPA Mendez interviewed children (C1-C7) on 1/13/23 and 4/11/23. LPA was able to interview 6 of 7 children. LPA Mendez asked children if any of the teachers had hurt them in which 5 of 6 children stated no. LPA Mendez asked children if any of the teachers had hurt them in which 1 of 6 children stated yes that S1 had grabbed them by the back of the shirt. LPA asked children what happens when they get in trouble at school, 3 of 6 children stated they go on time out. LPA Mendez asked children where they are placed in time out in which 2 of 6 children stated that they were put on time by the gate in the classroom. LPA asked children if they feel safe at school in which 6 of 6 children stated yes they feel safe.

During today’s visit facility was toured. LPA observed 5 staff present and 21 children present.

Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred, and the findings are unsubstantiated. An exit interview was conducted. The Notice of Site Visit must be posted for 30 days.
