On 8/8/24 at 2:17pm, Licensing Program Analyst (LPA) Bianca Mendez and Kayla Danielson conducted an unannounced complaint inspection, and met with licensee Nikki Ray. It was alleged that facility is operating out of ratio.

The licensee was interviewed on 6/5/2024 at 8:20am and admitted to knowledge of the allegation and stated that that there are times when they are operating out of ratio. Some teachers do not get in until after 8:30am and they can only work in a 8 hour shift. Licensee stated it varies with the school schedule, some staff call in sick and they call in last minute for a sub or they arrive late after their scheduled hours. Licensee stated that families are not abiding by contracted times.

LPA interviewed staff (S1-S5) on 6/5/24 and 4 of 5 staff stated they were not out of ratio. 3 of 5 stated no there is no shortage of staff at the facility. S2 stated that the issue they have been having is that more people call off work and then that puts them out of ratio and parents are not coming to pick up at their contracted time. S2 stated they have talked to parents about coming in at their contracted time. S3 stated that no, they are not experiencing a shortage of staff, only if someone decides to call out sick then they will try to find an extra teacher.

During today’s inspection, the facility was toured. LPA observed 27 children and and six 6 teachers were present.

Based on the evidence obtained, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. California Code of Regulations, (Title 22), is being cited on the attached LIC 9099D.

Licensee stated they will be communicating with parents about picking up and dropping children at contracted time. Staff will be aware of contracted time. Licensee will submit a plan of correction to CCLD by 8/18/24.
