32 | On 12/3/25 LPA Laird conducted interviews with 4 staff (S1-S4). Three of the staff interviewed stated the temperature in the facility has fluctuated with temperatures being 65 degrees or below since last Wednesday. Three staff stated the thermostat was replaced on Tuesday afternoon. One staff stated children have had to nap in coats and have complained about being cold. Four staff interviewed stated the director is present part of the day.
On 12/3/25 LPA Laird conducted an inspection of the facility. LPA Laird observed the thermostat reading at 66 degrees @ 8:35am, 65 degrees @ 9:00am, and 68 degrees @ 10:34am. At 8:34am LPA Laird observed children sitting in the preschool room wearing jackets. The facility director was not present during inspection. At 10:42 LPA Laird conducted 1 staff file review.
On 12/1/25, 12/2/25, and 12/3/25 LPA Laird received text messages and photos indicating the temperature in the facility was between 55-63 degrees since the week of 11/25/25. 2 Photos depicted children in coats and mittens in the playroom.
Based on interviews, observations, file review, and evidence obtained, LPA Laird has determined there is sufficient evidence to suggest the allegations have merit.
Based on the evidence obtained, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. California Code of Regulations, (Title 22), is being cited on the attached LIC 9099D.
LPA Erica Laird informed facility representative Rhiannon Thruman that this report dated 12/3/25 documents 2 Type A citation(s) which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care.
Also, LPA Erica Laird informed Rhiannon Thurman to provide a copy of this licensing report dated 12/3/25 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
Exit interview conducted and report was reviewed with facility representative, Rhiannon Thurman. Appeal rights were provided.
A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
