On 03/05/2026 at 12:30 Licensing Program Analyst’s (LPA’s) Kareeca “Reeca” Sykes and Mone Flores conducted an Unannounced Subsequent Complaint Investigation at KinderCare Learning Center #1039. LPAs met with Director, Selene Acosta and explained purpose of investigation. LPA’s observed 35 preschool age children in three (3) classrooms with six (6) staff. Director informed LPA’s that there is currently 49 preschool age children enrolled.

Complainant alleges that “Staff left day care child without supervision”. During the course of the investigation, LPA’s inspected the facility, reviewed records and conducted interviews. It was determined that after returning from outdoor play time, S1 went to help S2 redirect children that were being aggressive towards S2 when C1 ran out the door to the play yard. P1 informed S1 and S1 ran out to retreive C1 and returned C1 to the classrooom.

Based on the interviews and information obtained throughout the investigation, the preponderance of evidence standard has been met. Therefore, the allegation is SUBSTANTIATED. California Code of Regulations, Title 22, Division 12 is being cited on 9099-D page. Page 2 continued on 9099-C

By 03/13/2026, Director stated they will conduct an all staff meeting and review the importance of supervision submit a written statement on how facility will remain in compliance. Director will submit attendance sheet to LPA as well as Lack of Supervision worksheet from staff

This requirement has not been met as evidenced by: Based on interviews, the facility did not comply with the section cited above when P1 informed S1 that C1 had ran out of the classroom to the play yard and S1 went to retrieve the child which poses an potential risk to the health, safety or personal rights of children in care.
