On 1/8/24 Licensing Program Analysts (LPAs) Monica Mathur and Dealia Frison conducted an unannounced subsequent complaint investigation at New World Child Development Center Walnut Creek. LPAs met with Licensee, May Chen. LPAs explained the purpose of today's visit.

Complainant alleges that staff member speaks inappropriately to day care child(ren) in care. During course of investigation LPAs conducted interviews, facility inspection, observtions and reviewed records. It was determined that an incident occurred where the Director spoke to a child about toilet training in front of parents in a manner which was perceived as scolding and inappropriate verbal interaction with child. Interviews and evidence show although the incident happened, it was not done in a severe manner that posed danger or immediate risk to the health and safety of child in question. However, it was a violation of child's personal rights and posed a potential risk. Director is reminded to be mindful about how to speak to children in the presence of parents and staff in a manner not be perceived as humiliation, intimidation, ridicule and threatening.

Complainant alleges that staff member yells at day care child(ren) in care. During course of investigation LPAs conducted interviews with staff, children and parents, did facility inspection, observations and reviewed records. It was determined there have been occasions where staff spoke to childen in a manner that was perceived as yelling and aggressive. Director also engaged in heated verbal conversation with other staff members in the presence of children. Interviews and evidence show although the incidents happened, they were not in a severe manner that would pose immediate danger or risk to the health and safety of children. However, it posed a potential risk to the children in care and violation of their personal rights.

LPAs provided consultation and Director and staff are reminded to be mindful about how they interact among each other in the presence of children and reminded staff not to engage with children in a tone/manner that can be construed as aggressive shouting and yelling. Children must be accorded dignity in his/her personal relationships with staff and other persons.
