Centralized Application Bureau (CAB) Licensing Program Analyst (LPA) Alecia Sifuentes and met with Applicant Lori Castillo for the purpose of a pre-licensing inspection. Applicant requests a school-age license to serve 75 school-age children from transitional kindergarten to thirteen years. The program will operate Monday through Friday from 6:30 a.m. to 6:30 p.m. The fire clearance (STD850) was granted and received on 9/9/2024. LPA observed on the STD850 that the fire inspector has limited the capacity to 38 children at one time in the day care building (D1). Applicant stated that the Division of the State Architect (DSA) informed the school district that the day care building can occupy up to 48 children.

The facility will be providing breakfast and afternoon snacks during the school year and during holidays and summer. LPA reviewed with applicant the LIC 311A, Records To Be Maintained At The Facility, for child’s records, personnel records, administrative records, and documents to be posted.

INDOOR ACTIVITY SPACE:

There are two school-age classrooms located in the day care building (D1). LPA observed a sufficient amount of equipment, tables, chairs, and cubbies. Medication and first aid kit will be stored in the upper cabinet. LPA observed cleaning disinfectants are appropriately stored and inaccessible to children. Applicant stated there are no poisons or firearms on the premises. LPA observed a water dispenser and water fountain in the classroom. LPA observed a dual smoke and carbon monoxide detector in the classroom. LPA observed a sign in/out binder.

Applicant has requested a capacity of 75 school-age children. Per Health and Safety Code 1596.806, the facility is exempt from square footage requirement. However, due to the granted STD850 limiting the program to no more that 38 school-age children, LPA measured the two school-age classrooms. The total classroom spaces contain a total of 1,576 square feet, which will accommodate 45 school-age children. The children will use the school’s restrooms and restroom located within the day care building, and a separate private restroom for the staff is located by the back door. Children who become ill during the day will be isolated in the office and will use the staff restroom, if necessary.

OUTDOOR ACTIVITY SPACE:
There is one outdoor area on the property. The outdoor play area is fenced with a chain link fence that is at least four feet tall. LPA observed a sufficient amount of equipment and toys. There are no bodies of water on the premises. There are shaded areas supplied by overhangs. Per Health and Safety Code 1596.806, the facility is exempt from square footage requirement; therefore, LPA did not take measurements.

Incidental Medical Services (IMS) policy was discussed. For IMS information see PIN 22-02-CCP. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. LPA discussed the following: supervision; personal rights; inspection authority; reporting requirements; staff to children ratios and capacity; staff qualifications; and maintaining buildings and grounds. LPA discussed with Applicant any changes that may occur regarding the director or an employee acting in the director's absence must be reported to department within 10 working days.

Applicant was reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5-days or, if the penalty is for a repeat violation, for a maximum of 30-days per person will be assessed if this regulation is violated.

Applicant was informed of the MyChildCarePlan.org site, a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

Written Directives for Lead Testing in Child Care Centers: Assembly Bill 2370, Chapter 676, Statutes of 2018, added Health and Safety Code section 1597.16 requiring all licensed Child Care Centers constructed before January 1, 2010, test their water for lead between January 1, 2020 and January 1, 2023, and then every 5 years after the date of the first lead testing. For a license issued on or after July 1, 2022, initial testing results shall be received and posted within 180 days of licensure.
