On Wednesday, February 4, 2026, Centralized Application Bureau (CAB) Licensing Program Analysts (LPAs) M. Domantay, Kareeca Sykes, and Mone Flores met with Applicant Charles Armstrong and Director Toshiba MCcree for the purpose of a pre-licensing inspection for a new application that was submitted for a new child care center. Applicant requests a single licensed child care center for a toddler program 18 to 36 months (capacity 20), preschool program ages two years to 5 years old (capacity 40), and school age program (capacity 30) ages 5 years to 12 years, license to serve a total of 90 children. The program will operate Monday through Friday from 6:00 a.m. to 6:00 p.m. The fire clearance was granted and approved on 10/23/2025 from the Contra Costa County Fire Protection District.

LPA reviewed with applicant the LIC 311A, Records To Be Maintained At The Facility, for child’s records, personnel records, administrative records, and documents to be posted.

INDOOR ACTIVITY SPACE:

LPAs conducted measurements for all toddler, preschool, and school age programs indoor and outdoor areas. There is 1 toddler area: toddler classroom on the upper level of the building. There are 1 preschool area 1: preschool classroom in the upper level of the building. There is 2 school age areas (main area 1, activity nook area, area 2: the school age areas are located in the lower level of the building. LPAs observed a stair case that goes down to the school age area from the preschool and toddler area upper level and observed a lock on the door. LPAs observed sufficient amount of equipment, toys, tables, chairs, and cots during today's inspection. LPAs observed a first aid kit available in each programs classroom. Per director medications will be stored in the directors area on the upper level in a locked drawer.

Per Director entrance for the school age for drop up and pick up will be in the lower level through the outdoor gate and the entrance for the preschool will be from outdoor gate and children will come up the upper level outdoor staircase to get to the toddler and preschool areas in the upper level.

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

LPAs observed cleaning disinfectants are appropriately stored and inaccessible to children. Per Applicant stated there are no poisons or firearms on the premises. LPAs observed a combination smoke and carbon monoxide detector in the preschool classroom area 1. Per applicant facility will utilize manual sign-in/sign-out system.

Toddler Indoor Classroom measurements are:

The Indoor total measurements contain a total of 602.73 square feet, which will not accommodate Applicant's request for 20 toddlers.

Preschool Indoor Classroom measurements are:

The Indoor total measurements contain a total of 878.99 square feet, which will not accommodate Applicant's request for 40 preschool children.

School Age Indoor Classroom measurements are:

The Indoor total measurements contain a total of 915.20 square feet, which will not accommodate Applicant's request for 30 school age children.

LPAs advised applicant that the following first-aid supplies in a location accessible to staff must be inaccessible to children: current edition of a first-aid manual, sterile first-aid dressings, bandages or roller bandages, adhesive tape, scissors, tweezers, thermometer, and antiseptic solution.

There are 2 toilets and 2 sinks designated for the preschool children to utilize located between the preschool classrooms. There are 2 toilets and 2 sinks designated for the school age children located down stairs in the school age area. There is a changing table in the preschool area by the preschool bathroom. LPAs notified applicant a sink must be installed in hands reach of the changing table and must be moved to the toddler classroom area and must provide LPAs with a photo once install. There is no separate private restroom for the staff located in the facility, per Applicant the owner of the building next door has given them permission to utilize their bathroom and wrote a letter of approval. LPAs notified Applicant will discuss staff bathroom with Licensing Program Manager (LPM) and Regional Manager (RM).

The facility was observed to be clean, safe, sanitary and in good repair to ensure the safety and well-being of children and employees. LPAs notified applicant a comfortable temperature for children shall be maintained at all times. Furniture and equipment were observed to be maintained in good condition, free of sharp, loose or pointed parts.

Children who become ill during the day will be isolated in the upper level for toddler and preschoolers in the directors area and the book nook area 2 of the school age classroom for school age children.

Toddler Outdoor Play Yard measurements are:

Outdoor total measurements contain a total of 697.10 square feet, which will not accommodate Applicant’s request for 20 toddler children.

Preschool and School age Outdoor Play Yard measurements are:

Outdoor total measurements contain a total of 4228.33 square feet, which will accommodate Applicant’s request for 40 preschool children and 30 school age when on a rotated schedule.

TODDLER, PRESCHOOL, AND SCHOOL OUTDOOR ACTIVITY SPACE:

There is 1 toddler outdoor area at the facility. There is 1 outdoor play area for the preschool and school age program that the applicant is requesting to be shared on a schedule rotation. LPAs inspected all programs play yards. The toddler, preschool/school age play yard is fully fenced all around with black metal/steel gating and tarp. The toddler barrier between the toddler and preschool/school age play yard is a brown and white wooden gating/barrier.

LPAs observed grass surrounding areas of the toddler, preschool/school age play yard as cushioning to cushion a child's fall. LPAs notified applicant that additional cushioning such as tan bark, rubber matting is needed due to the dips in the grass/dirt in all of the outdoor play areas. LPAs notified applicant to send photos of any additional cushioning to CAB LPA and assigned LPAs. LPAs did not observe a play structure in any of the programs play yards. LPAs observed a sufficient amount of outdoor equipment and toys. There are no bodies of water on the premises. LPAs reminded applicant and director to ensure to empty all water tables when not in use. There is sufficient shading areas in the programs play yards that is a canopy and umbrella canopy. Per Director there is a train track on the other side of the outdoor play yards and over the train tracks is a river.

The facility provides breakfast, snack, and lunch. Water is provided by private tap water and bottled water by the facility.

Drinking water from a non-contaminating fixture or container shall be readily available both indoors and in the outdoor activity area. Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test as specified in Health and Safety Code section 1597.16.

For child care center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1-CCP.).

Applicants were reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5-days or, if the penalty is for a repeat violation, for a maximum of 30-days per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with Applicants and discussed the Child Care Licensing Safe Sleep webpage at:https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep, as an additional resource. LPA also informed Applicants of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at: https://www.cpsc.gov/, and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Applicants were informed of the MyChildCarePlan.org site, a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

A notice of site visit was given to Applicant Charles and must remain posted for 30 days.

Exit interview conducted and report was reviewed with Applicant Charles Armstrong.

The following items are required before a license will be issued:

1. Licensing Program Manager (LPM) final file review.

2. Applicant must install additional tarp and dirt or tan bark to secure the gating/barrier of the preschool and school age preschool.

3. Applicant must install sink in hands reach of the changing table and must be moved to the toddler classroom area and must provide LPA with a photo once install.

4. Applicant must submit a request for a waiver for the toddler play yard to be shared between toddler groups with a set schedule in place.

5. Applicant must submit a request for a waiver for the preschool and school age program to share the outdoor preschool play yard to be shared between preschool and school age groups with a set schedule in place.

6. Sounding alarms must be installed on the following doors: toddler area entrance door leading out to the street, outdoor gate leading to the parking lot by the toddler play yard.

7. Applicant must install a high door and lock leading to the kitchen area in the school age areas in the lower level.

8. Applicant must install a lock on the electric door in the school age area in the lower level in area 2 activity nook.
