On 03/25/2026 at 9:45 A.M., Licensing Program Manager (LPM) Belinda Devall from the Centralized Application Bureau (CAB) and Licensing Program Analyst (LPA) Kareeca Sykes from the Oakland North Child Care Regional Office met with applicant Charles Armstrong for the purpose of a follow-up Prelicensing inspection for corrections from initial inspection. There were no staff or children present at the visit. LPM Devall and LPA Sykes toured the facility to conduct a heath and safety inspection.

The program will operate Monday through Friday from 6:00 a.m. to 7:00 p.m. The facility consists of two levels designed to provide care for toddlers, preschool, and school-age children.

On the upper level, toddlers and preschool children are assigned to separate classrooms with no commingling. The toddler classroom is equipped with an operable sink adjacent to the changing tables and three potty chairs for children’s use. The approved capacity for the toddler program is 17 children at any one time. An alarm is installed on the front door near the toddler entrance to alert staff when the door is opened. Ill toddlers will be isolated in the designated area located to the left of the stairs leading to the school-age classroom and will utilize the potty chair. LPM Devall recommended applying a transparent privacy film or installing a curtain on the window near the changing table to ensure privacy for children during diaper changes and when using the potty chairs.

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

The preschool classroom is approved for a maximum capacity of 25 children at any one time. Preschool children have access to two restrooms, each containing one sink and one toilet, for a total of two sinks and two toilets. Ill preschool children will be isolated on the right side of the classroom, across from the restroom, and will use the restroom on the right side. The preschool restrooms will be equipped with stepping stools and toilet seat adapters that securely fit adult toilets to support children’s safe and independent use.

The school-age program is located on the lower level, with a maximum capacity of 26 children at any one time. School-age children have access to two restrooms, each containing one sink and one toilet, for a total of two sinks and two toilets. Ill school-age children will be isolated in the area identified as the “nook,” located across from the right-side restroom, and will use the restroom on the right side. Locks and high barriers have been installed to prevent children from accessing restricted areas, and the alarm system is operational in this section of the facility.

The facility does not have a designated restroom solely for ill children or staff use. The facility will submit a waiver request to allow shared restroom to use and a safety plan addressing the prevention of commingling and sanitation procedures following restroom use by an ill child.

Children may enter through the front door, which opens into the toddler room, or through the outdoor play area. The facility will ensure that all children are escorted by a staff member or parent to their assigned classroom to prevent commingling. An escort plan will be implemented to ensure children are supervised and separated by age group while transitioning between program areas.

The outdoor play area provides separate activity spaces for toddlers and preschool children. The school-age children do not have a separate yard. The facility has requested a waiver to allow preschool and school-age children to share the outdoor activity space on a staggered schedule to prevent commingling. The fence gate leading to the side parking lot has an alarm that sounds when opened.

A hair salon located adjacent to the facility has stairs that lead into the outdoor activity space designated for exclusive use by the program. The facility will install a barricade at the base of these stairs to prevent children from accessing the stairs or the upper-level outdoor area of the hair salon.

The facility has placed tarps along the fencing and secured them with zip ties. However, portions of the tarp were observed to be loose. The facility will tighten and fully secure the tarp. It is recommended that zip ties be fastened horizontally along the stable fence rail to ensure a secure attachment, as wind may cause vertically attached zip ties to loosen.

The facility has a total of 4 toilets, 5 sinks and in addition to 3 potty chairs to be used by children under 24 months to meet the total capacity of 68 children.

The following corrections must be made prior to licensure:

• Submission of a waiver request to allow the school-age restroom to be shared with staff and ill children. The waiver must also address the use of one preschool restroom and a potty chair by ill children, including sanitation procedures following use. In addition, the potty trained children may use the preschool restroom.

• Installation of a barricade at the stairs leading from the neighboring hair salon into the outdoor activity area.

• Ensuring that the tarp along the fencing is tightened and securely fastened to prevent children from climbing under or through the fence, which borders the train tracks and river.

• Submission of escort plan to ensure children are no moving through the facility and between each components to prevent commingling.

Exit interview conducted with the applicant, Charles Armstrong. The applicant will contact LPM with proof of corrections prior to licensure.
