On 03/14/2024 at 10:45 AM, an unannounced complaint inspection was made to the facility by Licensing Program Analysts (LPA) Kiriko Lynch and Noah Wheeler. It was alleged that the Licensee is not allowing a day care child's parent to enter and inspect the facility, specifically that the licensee is not allowing Parent 2 (P2) to enter the facility without an appointment. The licensee was interviewed on 1/17/27 and denied the allegation. The licensee stated that the parents of child 1 (C1) are separated. The licensee stated Parent 1 (P1) initially enrolled the child and has primary custody of C1. The licensee stated there is a custody schedule, and that P2 wanted to visit the facility on days that were not P2’s scheduled days.
C1’s file and records were reviewed. It was observed that P1 and P2 had joint physical and legal custody of C1, and there was no court order prohibiting either parent from visiting the facility. Based on the evidence obtained, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. California Code of Regulations, Title 22 is being cited on the attached LIC 9099D. Appeal rights were provided and exit interview conducted with the licensee. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
