Licensing Program Analyst (LPA) Soleil Marx met with Facility Representative, Leslie Dillon, for the purpose of delivering findings to a complaint investigation alleging that staff yell at day care children and staff use inappropriate discipline practices with day care children. The purpose of today's inspection was explained. LPA observed a census of 42 preschool age children being supervised by five staff.

Throughout the course of the investigation, LPA made observations of staff/child interactions and conducted interviews with staff, authorized representatives, and children.

LPA observed staff communicating with and guiding children using a tone of voice of an appropriate volume. LPA observed teachers getting down to children’s level while speaking with them. LPA observed while inside the classroom, you could not hear staff talking unless within close proximity. Staff statements revealed inside they use an inside voice with children and the only time their voice is raised is when they are outside and there is a safety concern that needs their immediate attention, and they are not in close enough proximity to intervene.

LPA observed staff using verbal redirecting and the 1,2,3 system as discipline methods. Interviews with staff revealed natural consequences are used as the discipline policy such as misuse of a work station means the teacher chooses their work station and the 1,2,3 method involves giving the child a chance to fix the behavior before the teacher will help them. LPA reviewed the facility handbook/parent agreement on discipline which coincides with staff interviews regarding natural consequences being utilized. LPA observed teachers physically helping children such as holding their hand and leading them to a new activity station but did not observe staff rough handling children.

Interviews conducted with children and authorized representatives did not reveal concrete information that would corroborate the allegations.

LPA did not obtain any pertinent evidence through observation or interview during the investigation to prove the above allegations. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are unsubstantiated.

Exit interview was conducted. Report reviewed with Facility Representative. Appeal rights were provided. A notice of site visit was given and must remain posted for 30 days.
