Licensing Program Analyst (LPA) Michelle Pascual met with Director Michelle Duffy to deliver findings for the above allegations.
According to the complaint the allegations are as follows, “Facility staff left day care child in a soiled diaper for an extended period of time, facility staff is not following Covid-19 guidelines and facility staff did not follow day care child's feeding plan.” The allegations were investigated through interviews with five (5) teachers including the Director and parents in care. LPA had also conducted facility and classroom observations for COVID compliance. LPA found some discrepancies on the feeding plan versus what was being communicated. After speaking to the specific teachers within the infant room, LPA found they were utilizing the infant needs and services plan as well as separate communication relayed to the facility. The needs and services plan stated that child #1 (C1) was introduced to solids while in care. LPA found that were was some misunderstanding of when solids were to be fed based on the needs and services plan and how it was interpreted with facility staff.

LPA did find that there was some confusion with what was written on the plan and on the e-mail resulting in a discrepancy. LPA investigated the allegation regarding the soiled diaper and found that per the Kindercare corporation policy, each child is changed every two-hours at a minimum with periodic diaper checks in between as well as changed when necessary. LPA could not confirm or deny the child was left in a soiled diaper for a prolonged amount of time.

LPA investigated the COVID-19 protocol that the Kindercare Corporation has implemented. Per their regulations (which is also stated on their website) they follow the CDC guidelines and have all adults wear masks, those staff who are vaccinated can remove their masks outside while socially distanced. Children are encouraged to wear them at age 2 and up and it is required for children aged 5 and over. LPA found the facility was in compliance with their regulations.

Based on the conflicting information obtained throughout the course of this investigation the above allegation could not be substantiated or dismissed. Although the allegations may have happened (or is valid), there is not a preponderance of the evidence to prove the alleged violations did or did not occur, therefore the finding is UNSUBSTANTIATED.
