Licensing Program Analysts (LPAs) Arianna Manabat and Soleil Marx met with Director Robert (Robb) Staples at approximately 9:15 AM to deliver the complaint findings for the allegations mentioned above. LPAs observed 33 infant children in care being supervised by 10 staff members, and the director.

It was alleged that facility staff did not provide care as necessary and that children were not accorded dignity. Through observations, record review, and interviews with the staff, Director, and the reporting party (RP), LPAs found that staff member's conduct, as evidenced by a video recording, did not violate the children's personal rights. LPAs noted that the video that was posted lasted a short duration of time, approximately 20 seconds, and showed the staff member dancing in the video.

Director was made aware of the video and took immediate action to address the posting. The staff member was reminded of facility policy for media postings during work hours. The Director immediately sent in an Unusual Incident report to Sacramento Regional Office. Continued on 9099-C....

Based on the information obtained, LPAs were not able to determine that facility staff did not provide care as necessary and that children were not accorded dignity. Therefore, the allegation is determined to be UNSUBSTANTIATED, meaning that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove it. An exit interview was conducted.

Notice of site visit and appeal rights were also addressed. The Notice of site visit shall remain posted for 30 days for guardian/parental review.
