On 05/24/2023, Licensing Program Analysts (LPAs) Ruby Ocegueda and Paul Garcia conducted an unannounced Annual Required Inspection for the preschool license. LPAs met with Site Supervisor, Angelita Rodriguez and toured the facility indoors and outdoors. Days and hours of operation are Monday through Friday 7:45 AM to 3:15 PM. This facility is closed through the Summer and follows the traditional school year schedule.

There is no swimming pool in this facility. During the inspection of the play yard, it was observed that there was a collection of water in approximately three zones near the flower beds along the perimeter of the play yard. The largest area of water collected was approximately 2ft by 2ft in size. The water was approximately 3.5 inches in depth at the deepest point in each of the areas of concern. Site Supervisor also observed the water and confirmed the observation. Also outside in the play yard, LPA’s observed an unattended water table that had approximately 1 to 1.5 inches of water collected. Per Site Supervisor, the water was placed there this morning at 8:00 AM, and today the water was observed at approximately 10:30 AM. LPA’s discussed personal rights and maintaining a safe and healthful outside environment for children. There are no firearms or ammunition allowed or stored on the premises. Disinfectants, cleaning solutions, medication and other hazardous items are made inaccessible. No poisons were observed during the inspection.

Furniture and equipment are in good condition, free of sharp, loose or pointed parts. Playground equipment is in safe condition, free of sharp, loose or pointed parts. The surface of the outdoor activity space was inspected today. All toilets and handwashing facilities are in safe and sanitary operating condition. Floors in the facility are clean and safe. The facility provides breakfast, lunch and snack. The meals are prepared in a central kitchen and transported the facility each day. The meals are stored in the kitchen. All kitchen, food preparation and storage areas are clean, free of litter/rubbish and free of rodents/vermin. All foods/beverages capable of rapid spoiling are stored in covered containers at 45 degrees F or less. Report continued to 809-C

Based on observation and interview, the licensee did not comply with the section cited above . LPA's observed that there were three areas in the play yard along the fence that had a collection of water. The largest of the areas measured approximately 2ft by 2ft in size and were as deep as approximately 3.5 inches in depth. Per Site Supervisor, the water was collected from sprinkler water. Also in the play yard, was a water table that had approximately 1 inch to 1.5 inches of water collected inside. Per Site Supervisor, the water in the water table had been there since approximately 2 hours prior from the time of observation. This poses a potential health, safety or personal rights risk to persons in care.

Today, Site Supervisor dumped the water from the water table and LPA discussed safe and healthful accommodations which should include no standing water anywhere in accessible areas of the play yard. Site Supervisor stated she would submit a work order to request that the issue surrounding sprinkler or rainwater being collected in areas of uneven grounds to be remedied. Proof of work order, written plan of action describing how the facility will avoid the collection of water in any area of the play yard as well as photos of final applied corrective action will be submitted to the Department by POC date : 6/21/2023.

Assembly Bill 2370, Chapter 676, Statutes of 2018 requires all Child Care Centers (CCCs) that are located in buildings constructed before January 1, 2010 to test their drinking water for lead contamination by January 1, 2023 and every 5 years thereafter. This facility has provided evidence of completed water testing for samples collected on 10/20/2022 and 2/28/2023 with no action level exceedances noted. Drinking water is available both indoors and outdoors. Areas around high climbing equipment, swings and slides have cushioning material to absorb falls. All materials and surfaces accessible to children are toxic free. The facility is free of flies, insects and rodents. Facility has one or more functioning carbon monoxide detectors that meet statutory requirements. Prior to working or volunteering in a licensed child care facility, all individuals subject to a criminal record review have received a criminal record clearance or exemption. No individuals excluded by the Department are allowed to be present. Capacity and limitations as specified on the license are being maintained. At least one person trained in CPR and Pediatric First Aid is present when children are at the facility or at offsite activities. The name of the child care center director or fully-qualified teacher(s) designated to act in the director’s absence has been reported to the Department. All children are under supervision, including visual supervision, of a teacher at all times. Facility maintains a ratio of one teacher supervising no more than 12 children in care. LPA reviewed a sample of children’s files and observed files were complete with contact information for authorized representative and or relatives or others who can assume responsibility for the child. LPA reviewed a sample of staff files and observed files were complete with documentation of meeting qualification requirements, immunization records for influenza, pertussis and measles and current documentation of completed mandated reporter training. Menus are posted at least one week in advance where an authorized representative can view them.

Incidental Medical Services (IMS) are currently being provided. Licensee is aware that an IMS plan is required to be submitted to the licensing office if they provide any of these services. LPA and Licensee discussed the Community Care Licensing website www.ccld.ca.gov which will provide access to Provider Information Notices (PINs), Quarterly Updates, COVID-19 Information and Resources, Mandated Reporter Training, Safe Sleep in Child Care, Lead Poisoning Facts, Forms and Regulations.

Per Title 22, Division 12, Chapter 3, of the California Code of Regulations, the following deficiency is being cited: (see next page, 809 D) Licensee was provided a copy of their appeal rights.

An exit interview was conducted with Site Supervisor Angelita Rodriguez. This report shall be made available to the public upon request. LIC 9213 Notice of Site Visit is provided and required to be posted for 30 days.
