25 | On 11/30/2023, Licensing Program Analyst (LPA) Aurelio Mendoza conducted an unannounced case management inspection. LPA met with Assistant Director Sandra Dominguez to discuss an unusual incident which occurred on 09/26/2023. A complete file review was conducted prior to visit. LPA toured facility inside and outside. LPA took a census, interviewed staff, and observed area in which incident occurred.
The nature of the incident LPA followed up on today occurred on 09/26/2023 at approximately 5:00 pm encompassed an event where child #1 reported to staff #1 that child #2 had pulled their pants down in the playground area of the facility.
LPA observations, records reviewed, and interviews yielded that the facility was working in compliance with supervisory ratios and that the staff present during the time of the circumstances had direct line of supervision of children in playground area and were within 20 feet of the children when the event purportedly occurred however it cannot definitively be discerned that child #1’s pants were pulled down by child #2. LPA gathered substantiation that the facility staff teaches children about establishing healthy boundaries. The event is an isolated occurrence and not a result of lack of care and supervision. Furthermore evidence was obtained during the visit referencing that the facility practiced transparency on the matter and reiterating to staff the importance of teaching boundaries to children in care.
Based on the information obtained, LPA determined licensee handled the incident correctly. LPA determined licensee took appropriate measures to address the isolated event, followed proper policies and procedures and no regulations were violated.
Per California Code of Regulations Title 22, Division 12, no deficiency cited during today's inspection.
