Licensing Program Analyst (LPA) Aurelio Mendoza conducted an unannounced Annual/Random inspection of the facility licensed to provide care for preschool children. LPA met with Director Monica Curry and toured both the indoor and outdoor areas of the center.

The facility operates Monday through Friday from 7:00 a.m. to 6:00 p.m. and provides care for preschool children.

During the inspection, LPA observed that all cleaning supplies, disinfectants, medications, and other hazardous items were stored out of children’s reach. All poisons are kept in locked storage, and no poisons were observed at the time of inspection.

There is no swimming pool or other bodies of water on the premises. The facility does not have or allow any firearms or ammunition on site. LPA discussed the new pool safety requirements under AB 2866, which took effect on January 1, 2025, and informed Director Monica Curry that a Provider Information Notice (PIN 25-01-CCP) was issued on January 6, 2025.

LPA observed that all furniture and equipment were in good condition and free of sharp or broken parts. The playground equipment was safe, and the outdoor activity area was free of hazards. Areas around climbing structures, swings, and slides had appropriate cushioning material to help reduce injury from falls.

All toilets and handwashing stations were clean, safe, and in working order. The facility has working carbon monoxide detectors. Floors throughout the center were clean and free of hazards. Trash containers had tight-fitting lids and were in good condition.

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

Drinking water is readily available both indoors and outdoors. Children use their own personal water bottles, which are filled from a water dispenser. Disposable cups are also available if needed.

The facility provides morning and afternoon snacks, as well as lunch. All food is prepared on-site. Meals brought from home are not allowed to help manage food allergies. Menus are posted at least one week in advance in an area visible to parents or authorized representatives.

The facility is operating within the capacity and limitations stated on its license. LPA verified that at least one staff member trained in CPR and Pediatric First Aid was present during the inspection and is available during any offsite activities. The facility has reported to the Department the name of the director or a qualified teacher who is authorized to act in the director’s absence.

All children were under visual supervision during the visit, and the facility met required teacher-to-child ratios.

LPA reviewed a sample of children’s files and found that each file included emergency contact information and a medical assessment. A sample of staff files was also reviewed and found to include health screenings, immunization records for influenza, pertussis, and measles, as well as documentation showing completion of the mandated reporter training.

LPA discussed the Community Care Licensing website (www.ccld.ca.gov) with Director Monica Curry. This website provides access to forms, regulations, Provider Information Notices (PINs), and quarterly updates.

LPA also reviewed Reporting Requirements under Section 101212 and reminded Director Monica Curry that all adults (18 years and older), including staff and volunteers, must have a criminal record clearance or exemption before being present at the facility. Failure to comply with this requirement may result in civil penalties of at least $100 per day, per person, up to 5 days—or up to 30 days for repeat violations.

LPA reviewed information regarding Assembly Bill (AB) 2370, which requires all licensed child care centers built before January 1, 2010, to test drinking and food-preparation water for lead contamination. Testing must be completed before January 1, 2023, and then every five years. Facilities licensed after July 1, 2022, must test their water within 180 days of receiving their license. LPA verified that the required water testing was completed in accordance with PIN 21-21.1-CCP. LPA discussed Incidental Medical Services (IMS) and informed Director Monica Curry that if IMS is provided, the Plan of Operation must be updated and submitted to the Department. For more details, see PIN 22-02-CCP.

LPA also provided information about the Americans with Disabilities Act (ADA). The U.S. Department of Justice offers a toll-free ADA Information Line at (800) 514-0301 (voice) or (800) 514-0383 (TTY). A publication titled Commonly Asked Questions about Child Care Centers and the ADA is available at: https://www.ada.gov/resources/child-care-centers/.

Director Monica Curry was also informed about MyChildCarePlan.org, a helpful resource for families looking for child care and referral services throughout California.

An exit interview was conducted, and the inspection findings were reviewed with Director Monica Curry. Appeal rights were provided.

No deficiencies cited under Title 22, Division 12, California Code of Regulations.
