On 01/12/24, Licensing Program Manager (LPM) Juvenal Moctezuma and Licensing Program Analyst (LPA) Denisia Jimenez met with Director Tasha Avalos for an Informal meeting at the Fresno Regional Child Care Office. The purpose of today’s informal meeting was to discuss previous & recent violations of Title 22 Regulations pertaining to Children's personal rights being violated and Buildings & grounds. LPM Moctezuma reviewed and discussed the following with Tasha Avalos, and how the Child Care Center will maintain compliance with the deficiencies cited below.

The Department of Social Services, Community Care Licensing Division has determined that Kinder Care Learning Center violated the following Title 22 licensing regulations:

On 11/14/23, LPA Jimenez issued a Type A deficiency for violation of California Code of Regulations Title 22 Division 12 Section 101223(a)(1), which states: (a)The licensee shall ensure that each child is accorded the following personal rights :(1) To be accorded dignity in his/her personal relationships with staff and other persons. This requirement is not met as evidenced by: Based on interview, the licensee did not comply with the section cited above. Staff have handled multiple day care children in care in a rough manner on various occasions which poses an immediate health, safety, or personal rights risk to persons in care.

On 11/14/2023 LPA Jimenez delivered findings regarding a Complaint Allegation that Staff do not ensure that day care child(ren's) diapering needs are met while in care was found to be UNSUBSTANTIATED.

On 11/14/23 LPA Jimenez issued a Type A citation for violation of California Code of Regulations Title 22 Division 12 Section 101223(a)(3) - (a)The licensee shall ensure that each child is accorded the following personal rights: (3): To be free from corporal or unusual punishment, infliction of pain, humiliation, intimidation, ridicule, coercion, threat, mental abuse, or other actions of a punitive nature. Through interviews it was revealed that Staff have withheld snacks from day care children when they have behavioral issues on separate occasions which poses an immediate health, safety, or personal rights risk to persons in care.

On 08/30/22 LPA Pacheco issued a Type A citation for violation of California Code of Regulations Title 22 Division 12 Section 101223(a)(1) - (a)The licensee shall ensure that each child is accorded the following personal rights: (1) To be accorded dignity in his/her personal relationships with staff and other persons. Through Director statement it was revealed that Staff #1 was terminated for inappropriate handling of a child. This is an immediate danger to the health, safety or personal rights of children in care.

On 03/22/22 LPA Rodriguez issued a Type A citation for violation of California Code of Regulations Title 22 Division 12 Section 101238(a)(1) - The childcare center shall be clean, safe, sanitary and in good repair at all times to ensure the safety and well-being of children, employees and visitors. (1) The licensee shall take measures to keep the center free of flies, other insects, and rodents. Based on observation and interview, facility did not ensure center was free from cockroaches and clean, safe, and sanitary at all times. Cockroach infestations can cause health hazards. This poses an immediate risk to the health, safety, and personal rights of children in care. The entire center was cited, Preschool, Infant, and School Age.

On 01/28/22 LPA Rodriguez delivered findings regarding a Complaint Allegation that Teacher speaks inappropriately rough to day care children was UNSUBSTANTIATED.

On 02/11/2020 LPA Rodriguez delivered findings regarding a Complaint Allegation of Neglect/Lack of Supervision resulting in inappropriate interactions between day care children was Investigated by the Investigations Branch (IB) and found the allegation to be UNSUBSTANTIATED.

The Director has submitted plan of correction evidence for the above stated deficiencies.

The above deficiencies were reviewed and discussed during today’s informal meeting. The deficiency for the Type A violation on 11/14/23 was cleared on 11/21/23. The facility director confirmed that she retrained all staff on personal rights. The deficiency for the Type A violation on 08/30/22 was cleared on 08/30/22. Facility has taken steps to remedy the situation by suspending and terminating the employment of Staff #1. The facility has implemented plans of correction for the rest of the mentioned deficiencies as well.

COMPLIANCE PLAN

In response to these discussions, Licensee has agreed to the following:


1. Director agrees to comply with Title 22, Division 12, Chapter 1 of the California Code of regulations.
2. Director will retake the Child Care Center Orientation – Record Keeping & submit a copy of the certificate to the department by 02/09/24. This plan of correction is to ensure that director is aware of community care licensing title 22 regulations pertaining to Childrens Personal Rights, Buildings & Grounds, Infant Care Safe Sleep, & Sign in/Out procedures, & care and supervision.
3. The Director will watch the Resource Provider Videos and submit in writing what she learned and how she is going to implement what she learned from the video trainings by 02/09/24.
4. Community Care Licensing will increase frequency of site visits to the facility to monitor compliance.
5. The Director will ensure children are provided with a safe and healthful environment, and comfortable accommodations furnishing, and equipment at all times.
6. Director agrees to be referred to the (TSP) Technical Support Program.
The Director shall submit a written plan to Community Care Licensing Division and certificate of training attended by 02/09/24 indicating how the Center will comply with the above requirements. The Director states that she is in contact with Children's Network Services. LPA provided the licensee with resource and referral agency phone number.

Today, Tasha was informed that any further repeats of the above deficiencies will result in a Non-Compliance Conference and possible referral to the Legal Division for possible Administrative Action. Furthermore, Tasha understands that any repeats of the above deficiencies within a 12-month period will result in the issuance of civil penalties.

A copy of this report was given to the Director, Tasha Avalos. Per Title 22, Division 12, Chapter 1, of the California Code of Regulations, No Deficiencies are cited during today’s Office Visit.
