Licensing Program Analysts (LPAs) Brannon and J. Pacheco conducted an unannounced complaint inspection to provide findings of the above allegation. LPAs met with Director, Kari Salgado. LPAs reviewed the allegations, and toured the facility, inside and outside. LPAs observed 58 children with six adults.
Through the course of this investigation, LPA Brannon interviewed current, previous staff and parents.
Interviews reflect that during drop off, parents arrive at the front door and wait for staff to come out. Staff will conduct COVID risk assessment of child and take child’s temperature. Upon determining that child does not show any symptoms of COVID, staff will take child to child’s assigned classroom. During pickup, parent arrive at the front door, staff will come out or will call child’s teacher to inform that parent is here to pick up their child. Interviews reflect that preschool parents did not think of asking staff if they could come into their child’s classroom to inspect or ask to enter the front lobby to view required postings. However, it has come to the Department’s attention that licensee did provide flyers to parents stating that in order to inspect their child’s classroom, licensee prefers advance notice and that parents will be able to visit in the building during non-peak times. Parents/legal guardians do not have to make appointments nor inspect during non-peak times.

. LPA is recommending that licensee reviews Title 22, Section 101218.1: Admission Procedures and Parental and Authorized Representative’s Rights, including H&S code 1596.857: …parent or guardian of a child receiving services in a child day care facility has the right to enter and inspect the facility without advance notice during normal operating hours of the facility…if facility denies a parent or legal guardian the right to enter and inspect a facility or retaliates, the department shall issue the facility a warning citation. For any subsequent violation of this right, the department may impose a civil penalty…Parents/legal guardians do not have to make appoints nor inspect during non-peak times.

Interviews reflect that parents/legal guardians were not aware that they could inspect their child’s classroom or request to enter the front lobby, where the required postings are posted. Licensee does have a sandwich board outside facility’s front door. If licensee persists to keep required postings in the front lobby, parents are to be allowed into facility as they wish. LPA did recommend having CCLD required postings on the sandwich board to allow parents/authorized representatives the ability of viewing required postings without having to request to enter facility.

Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated.

Per California Code of Regulations, Title 22, Division 12, Chapter 1, no deficiency is cited during today’s visit. Exit interview conducted with the director, Kari Salgado. Appeal rights were provided. A Notice of Site Visit was posted on parent board in presence of LPA Brannon.
