25 | On 06/04/2024, Licensing Program Analyst (LPA) Ka Vang conducted an unannounced Case Management-Incident inspection and met with Director Belinda Tubbs. Also, present was Licensee Navjot Gill. The facility file was conducted prior to today’s inspection. LPA toured the facility and a census as taken. An Unusual Incident Report was submitted to the Fresno Community Care Licensing Office (CCL) regarding an incident occurred on 05/29/2024, where Fresno County Police Department (PD) was at the facility conducting an investigation. The PD was investigating the incident reported involve Staff #2 (S2) violated Child #1 (C1) personal rights. The purpose of this inspection was to investigate this incident.
During today's inspection, observation was conducted and facility files were reviewed and obtained. LPA also conducted interviews with staffs who were presented when the incident occurred. Per S1, who directly witnessed this incident, stated that as S1 came back from break and walk into the classroom, S1 observed S2 having S2’s upper body (left torso) on top of C1’s back as C1 was on the mate and about to go for a nap. Per interview with other staff members, it was disclosed that there were multiple times where S2 have used this approach of having her upper body and/or arm over children as they are about to fall sleep to ensure that the children eventually fall sleep.
It was disclosed that staff have not observed children getting injury from S2 putting her upper body and or arm over the children to have the children falls sleep; however, this approach had prevented children from moving or getting up from the mate when they are not sleep. With S2 using this approach, the children eventually fall sleep. Per interviews, S2 has utilized this method multiple times during napping time on multiple children.
Per Title 22, Division 12, Chapter 1, of the California Code of Regulations, there is deficiency being cited during today’s inspection. (See page LIC809-D for additional information).
Director was provided a copy of appeal rights. A notice of site visit (LIC 9213) was given and must remain posted for 30 days. This report shall be made available to the public upon request. Exit interview conducted and report was reviewed with Director. |
