32 | On 01/05/24, LPA De Haro issued a Technical Violation (TV) for the following California Code of Regulations Title 22 Division 12 Section 102417(b), which states: (b) The home shall be kept clean and orderly, with heating and ventilation for safety and comfort. During the indoor inspection, LPA De Haro observed a small hole in the dining room closet door. LPA discussed with licensee the importance of ensuring that the home is kept clean and in good repair at all times for the children’s safety. The licensee stated that she planned to fix the hole as soon as possible.
On 12/12/23, LPA De Haro issued a Type B deficiency for violation of California Code of Regulations Title 22 Division 12 Section 101223(a)(2), which states: (a) The licensee shall ensure that each child is accorded the following personal rights: (2) To be accorded safe, healthful and comfortable accommodations, furnishings and equipment to meet his/her needs. This requirement was not met as evidenced by: Based on the interview with the licensee and as confirmed by law enforcement reports, there was a verbal and physical altercation in the home during daycare hours, when children were in care. This posed a potential risk to the health, safety, or personal rights of children.
Licensee has submitted proof of correction for the above-mentioned deficiency, and the deficiency was cleared on 12/12/23.
Compliance Plan
In response to these discussions, Licensee has agreed to the following:
1. Licensee will ensure children are provided with a safe and healthful environment and the home shall be free from defects or conditions which might endanger a child.
2. Licensee agrees to comply with Title 22, Division 12, Chapter 3 of the California Code of regulations.
In addition, it was recommended that the licensee connects with her local resource and referral agency for additional support and training.
Today, Licensee was informed that any further repeats of the above deficiencies will result in a Non-Compliance Conference and possible referral to the Legal Division for possible Administrative Action. Furthermore, Licensee understands that any repeats of the above deficiencies within a 12-month period will result in the issuance of civil penalties.
A copy of this report was given to Licensee, Maria Cruz De Segovia. Per Title 22, Division 12, Chapter 3, of the California Code of Regulations, no deficiencies were cited during today’s Office Visit. |
