On January 04, 2024 at 8:46am, Licensing Program Analyst (LPA) S. Sims and E. Laird conducted an unannounced complaint inspection, and met with licensee Debra Ramsey. It was alleged that Staff hit children, and Staff sprays day care children with spray bottle. Specifically, that the licensee sprays day care children with a water bottle as a form of punishment and hits day care children as a form of punishment.
The licensee was interviewed on 09/05/2023 at 11:22am and denied the allegations. The licensee stated that staff do not spray children with water bottles as a form of punishment or hit children as a form of punishment.

5 parents (P1-P5) were interviewed on 11/13/2023, P1 – P4 denied the allegations and stated that they were unaware of the Licensee hitting or spraying children in care. P5 stated that the Licensee has sprayed C5 with a water bottle as a form of punishment and swatted C5 with a fly swatter as a form of punishment.

5 Children (C1-C5) were interviewed on dates 12/1/2023 and 12/04/2023, C1, C3 – C5 confirmed witnessing the licensee spray children in care with a spray bottle as a form of punishment. C1 substantiated that the Licensee has spanked C1 with their hand. C3 and C5 also stated Licensee has hit children in care as a form of punishment with a wooden spoon. C2 and C4 could not confirm if the licensee has hit any children in care.

During today’s visit facility was toured. LPA observed 5 children in care.

Based on the evidence obtained, the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. California Code of Regulations, (Title 22), is being cited on the attached LIC 9099D.

LPA S. Sims informed licensee Debra Ramsey that this report dated 1/4/24 documents 2 Type A citation which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care.

Also, LPA S. Sims and E. Laird informed the licensee Debra Ramsey to provide a copy of this licensing report dated 1/4/23 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

Exit interview conducted and report was reviewed with the licensee Debra Ramsey.
A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
