A prelicensing inspection was conducted today by Licensing Program Analyst (LPA), J. Snow. LPA met with facility representative Guadalupe Meraz. Applicant is requesting to be licensed for # 15 children, 10 preschool children age 3-6 years (in room #4) & 5 toddlers age 18-36 months in room 1,2,3 and the entry area. Hours of operation will be Monday -Friday, 7am – 5 pm. The facility uses the entire grounds.
The indoor and outdoor activity spaces were toured, and the facility sketch was verified. The following areas will be off limits to children: the kitchen will be gated and children will be escorted through to the play yard. The kitchen has a stove and refrigerator. There is a nap room for toddlers to sleep with 2 cribs. There are 13 mats/cots available. Preschool children will nap in the classroom. The isolation area for sick children will be located in the in the entry room. The changing table is located in the bathroom & needs to be relocated new a sink.
The outdoor play area is fully fenced; fencing needs repair. There is a broken play structure that must be removed. There is no pool, spa, pond, fountain, or any other body of water on the premises. The poisons are key locked in the kitchen. The facility is not set up for care (hazardous material, broken fences, lack of toys and equipment, spiders & spider webs, no hot water, no heat, refrigerator not working etc.) during the inspection. An additional visit may be required.
A capacity worksheet was completed during the visit. The inside, room square footage measured 1,022 square feet. Children have access to at least 2 toilets & sinks. The outside, yard square footage measured 3,902 square feet. Based on above, sufficient for the requested capacity. CONT....

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

10. Provide a variety of age-appropriate toys and equipment inside and outside.
11. Yard: Remove the broken climbing equipment, provide a suitable surface outside for children 18months old.
12. Inside: provide rugs & install cubbies for children
13. Replace missing ceiling tile in the preschool
14. Provide a cover or sheet to cover 18 sleep mats
15. Provide a first aid kit 101226(d) with all required equipment; (1) A current edition of a first-aid manual. (2) Sterile first-aid dressings. (3) Bandages or roller bandages. (4) Adhesive tape. (5) Scissors. (6) Tweezers. (7) Thermometer. (8) Antiseptic solution.
16. Yard: There is a chestnut tree in the play yard dropping choking hazards that may also be toxic. The applicant needs to provide a plan of how they will be made inaccessible including who is responsible, the task and the frequency.
17. Clear out or lock the closet containing paint, ladder and other equipment in the toddler room & lock the closet housing the hot water heater in the preschool bathroom
18. Provide covered trash can for diapering waste
19. Repair the heater, it was not operable in the preschool or toddler rooms

20. Preschool room: There is a metal cover on the wall heater which may get hot when heater is on; provide proof of correction or replace the cover. (not tested today because the heater is not functional). A visit may be required.
21. Repair hot water, not functional during inspection.
22. Clear yard of hazards: there is a pane of glass and rakes ect in the play yard area, must be cleared prior to care.
23. Provide additional shade will be needed in the yard; three trees in one area, add a second source for the paved area.
24. Submit plan to safely escort toddlers through the kitchen into the play yard. Make stove inaccessible (remove handles or purchase covers)
25. Install gate on kitchen door.
26. Yard: Wood chips are not a safe surface for 18-month-old children. please provide a safe surface
27. Yard: the fence in the corner of the play area is broken and the there are gaps in the large wood gate/driveway that needs repair. Be sure all fencing is repaired.
28. Yard: The metal fence in the driveway is climbable; fill in the gaps to make it 4' high.
29. Yard: The sandbox has not been inspected in a year, replace sand as needed and rid the lid surface of any possible splinters (paint).
30. Provide outdoor play equipment for toddlers and preschool children
31. Provide a trash can with a tight-fitting lid for diapering
32. Install a diapering station that meets the following requirement: 101439(h) - (h) Infant changing tables shall:(1) Have a padded surface no less than one-inch thick and be covered with washable vinyl or plastic. (2) Have raised sides at least three inches high. (3) Be maintained in good repair and safe condition. (4) While in use, be placed within arm's reach of a sink.
33. Provide indoor play equipment for toddlers and preschool children; 101439(l)(1) - toys must provide: (A) Auditory stimulation. (B) Visual stimulation. (C)Tactile stimulation. (D) Manipulative skills.
34. Shared yard waiver needed for toddlers and preschool. Please request by letter.

Criminal Record Clearance - Child Care Centers:
Guadalupe Meraz was reminded that all adults 18 and over responsible for administration or direct supervision of staff, persons who provides care and supervision to children, and staff who have contact with children, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5-days or, if the penalty is for a repeat violation, for a maximum of 30-days per person will be assessed if this regulation is violated.
