On 06/23/2022 at 10:00 AM, LPA Claudia Amador conducted a follow-up case management visit with program director Wendy Marquez regarding a self-reported incident on 3/16/2022.

During the incident investigation, the analyst conducted interviews with the program director and the staff members involved in the incident and reviewed report documentation. The analyst also reviewed the classroom #1-floor plan/layout and bathrooms.

Based on the information gathered, the analyst determined that on 3/16/2022, Child #1 (C1) was left alone napping in classroom #1. The four-year-old remained sleeping during the incident. Staff #1 (S1) was in the bathroom supervising six (6) children on the day of the incident. At the time of the incident, Staff #2 (S2) returned from her lunch break S1 was in the hallway leaving the bathrooms, 10 minutes after S2 noticed C1 was missing.S1 ran back to classroom #1 and found C1 napping on his cot.
The child was determined to have been alone in the classroom with no supervision for approximately 10 minutes before S2 noticed C1 was not with the group of children in the bathroom. S1 stated she counted the children and did not notice C1 missing. She also said she forgot to use the Daily Ratio Sheet. The LPA determined that the child suffered no injury or trauma from the incident. The program manager conducted an all-staff training for Active Supervision on 3/23/2022.
LPA Claudia Amador informed facility representative Wendy Marquez that this report dated 6/23/22 document(s) one Type A citation(s) which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care.

Also, LPA Claudia Amador informed the facility representative to provide a copy of this licensing report dated 6/23/22 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

A Type A deficiency under California Code of Regulations, Title 22, Division 12 & Chapter 1, is being cited on the attached LIC 809D.

An exit interview was conducted and the report was reviewed with the facility representative Wendy Marquez. A copy of this report, along with Appeal Rights (LIC9058 01/16), were provided. A notice of site visit was given and must remain posted for 30 days. LPA observed that the notice of site visit was posted during the inspection. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

All staff completed the Active Supervision Training on Wednesday, 3/23/2022. One-on-one training for teachers involved. The facility representatvie implemented a ratio log, bathroom policy, and ratio boards.
