On 06/13/2024 at 12:20 p.m. Licensing Program Analyst's (LPA's), Cindy Meier and Saul Zazueta conducted an unannounced complaint inspection to deliver the findings for the above allegations. LPA met with Licensee, Rosa Flores, and advised licensee of the purpose of the inspection and conducted a tour of the facility. There were five (5) children and facility assistant present during the inspection. Licensee's husband provided translation during the inspection for the licensee.

During the course of the investigation, interviews were conducted with licensee, licensee’s spouse, facility assistant, and daycare parents. Children were not interviewed due to age and verbal skills. The facility roster and photographs were obtained and reviewed by LPA.

It was alleged that on 3/15/24 licensee did not meet day care child #1 (C1’s) diapering needs while in care as parent of C1 stated when they arrived home, C1 had a diaper rash and observed a white product used for rashes had been applied. Parent stated licensee did not notify parent of the rash and applying of the product. Licensee stated when parent dropped off child in the morning, parent had expressed child had toileting issues the night before and therefore licensee applied product to prevent further discomfort.

It was also alleged that on 3/26/24 C1 was picked up from daycare and parent observed the inside of C1’s pants were soiled. Parent had notified the licensee later in the evening to discuss the situation and licensee expressed the child’s diaper was changed before the child left the daycare and was unaware that the pants were soiled. It was determined that this was not a common occurrence and licensee stated she will be diligent in checking children’s clothing.

It was also alleged that on unidentified dates the licensee does not feed C1 appropriate foods while in care and requires parent to provide C1’s own food. Licensee denied the allegation and stated that due to C1’s age, she provided soft foods that would not cause C1 to choke and asks the parent to provide other foods. Licensee stated she communicates the food policies verbally with parents when they enroll.

Daycare parents interviewed expressed a high level of satisfaction with the care the licensee provides and stated they had provided food for their child until a certain age.

Due to conflicting information obtained throughout the course of the investigation and no other witnesses to the alleged incidents, LPA was unable to determine whether or not the allegations occurred. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore the allegations are UNSUBSTANTIATED.



Exit interview was conducted and the report was reviewed with Licensee, Rosa Flores. A Notice of Site Visit was given and must remain posted for 30 days.
