On July 9, 2024, at 10:40 a.m., Licensing Program Analyst (LPA), Gloria Gonzalez conducted an unannounced Annual/Random and for the purpose of a Capacity Increase and met with the Licensee, Claudia Agramont.  LPA disclosed the purpose of the inspection and was granted entry into the facility by the Licensee.  Licensee accompanied LPA inside and out of the facility during this inspection. A granted fire clearance for 14 children was received on 6/13/24. Five (5) daycare children and one (1) staff member was present in the facility during this inspection.  Licensee and assistant meet immunizations requirements. This 2 story 4-bedroom, 3-bathroom home was toured and inspected to ensure the environment is safe for the care and supervision of children.
 
The applicant provided proof of control of property for review by the Department. The applicant will use the following areas for child care: downstairs family room/daycare room, living room, kitchen, dining area, bathroom #1 (hallway), and backyard. Off-limits areas include downstairs bedroom #1, the garage, laundry room, and the entire second floor including: master bedroom (#4), master bathroom (#3), bedroom #2, bedroom #3, bathroom #2.

The fire extinguisher, smoke detector, and carbon monoxide detector met requirements.  All hazardous items were inaccessible to children. The licensee has toys, play equipment and materials available.  The upstairs is not used and is gated off at the bottom of the stairway and the applicant understands the gate must be in place when children under five years are present during day care hours. LPA did not observe any bodies of water a the time of this inspection. Licensee stated there are no weapons in the home.  A review of staff records on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse clearances or exemptions.  Licensee’s First Aid and CPR certifications expire on 1/2026.  Licensee has required immunizations.  Licensee completed Mandated Reporter Training on 5/15/24. 3 of 3 children’s records were reviewed and contain immunization documentation and Notification of Parent’s Rights form.

LPA provided and discussed the following:  Report suspected child abuse and neglect, maintain children’s records according to regulation, post all required forms, and ensure that all adults residing or working in the home have criminal background clearances or exemptions.  Licensee was reminded that corporal punishment, smoking, exersaucers, bouncy seats, walkers, and jumpers and/or similar equipment are not allowed in daycare.  Licensee was also provided handouts with information regarding upcoming Safe Sleep Regulations/SIDS, Lead exposure and Shaken Baby Syndrome.  LPA and Licensee discussed California Megan's Law and LPA provided: www.meganslaw.ca.gov. During the exit interview, Licensee confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS.

Applicant was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

LPA advised that prior to making alterations or additions to the home or grounds, the applicant shall notify the Department of the proposed change. Applicant states they are financially secure to operate a family child care home for children and will comply with all regulations and laws governing family child care homes.

LPA discussed the maximum number of children for whom care shall be provided when there is an assistant provider in the home, including children under age 10 who live in the licensee's home and the assistant provider's children under age 10, shall be either: Twelve (12) children with no more than four of whom may be infants or Fourteen (14) children, with at least two of the children with 1 child enrolled in kindergarten and 1 child at least six years of age and no more than three infants, with landlord consent (LIC 9149).

Incidental Medical services (IMS) policy was discussed.  Licensee stated that Incident Medical Services are not being provided at this time.  For IMS information see Evaluator Manual – Regulation Interpretations and Procedures for Family Child Care Homes Section 102417.  When any IMS is provided, a Plan for Providing IMS must be submitted to the Department.  The following information regarding ADA was provided:  US Department of Justice (USDOJ) toll-free ADA Information Line at (800) 514-0301 (voice)/ (800) 514-0383 (TTY) and link to publication:  Commonly Asked Questions about Child Care Centers and the ADA, available at: http://www.ada.gov/childqanda.htm.

Because the applicant rents/leases the home, proof of landlord notification is required. The LPA observed the Property Owner/Landlord Notification form (LIC9151) that the applicant confirms was provided to the property owner/landlord. The applicant obtained a signed Property Owner/Landlord Consent form (LIC 9149).

No deficiencies cited.

A Large Family Child Care Home license may be issued upon final file review. LPA Gloria Gonzalez interpreted and explained inspection report to Licensee in Spanish, Licensee stated she understood.

An exit interview was conducted with Licensee, Claudia Agramont.  The licensee was provided a copy of their report and appeal rights (LIC 9058)

LPA provided notice of site visit, (LIC9213) and observed it being posted at the facility.
