On 01/24/2024 at 10:00 am, Licensing Program Analysts (LPA) Daniela Huerta conducted an announced pre-licensing relocation inspection with licensee, Cesar De La Torrei. The purpose of the inspection is to ensure the home is in compliance with standards established in CCR, Title 22, Division 12, Chapter 3, for Family Child Care Homes. This one story, three (3) bedrooms, two (2) bathroom house was toured and inspected. Days and hours of operation are Monday through Sunday, 3:00am - 2:00am.

Licensee will utilize the following areas for childcare: living room #1, bedroom #2, bathroom #1 and backyard. Off limit areas include kitchen, bedroom #1 and #3, bathroom #2, side yards, living room #2, dining room, garage and laundry room. Off limits areas are inaccessible to children by use of door knob covers, and gates. Licensee will utilize the backyard for outdoor activities. LPA informed licensee to ensure that children are always supervised during outdoor activities.

The fire extinguisher is rated 2A-:10-B:C located in living room #1. The smoke and carbon monoxide detectors meet requirements and are operational. Poisons, detergents, cleaning compounds, medications and other hazardous items were made inaccessible to children. There is no fireplace in the home. Licensee has children's toys, play equipment. The licensee has a working cell phone. Licensee stated there are no firearms or other weapons in the home. Licensee stated there are no bodies of water and LPA did not observe any bodies of water during the inspection.

Licensee's Mandated Reporter AB1207 expires on 03/7/2025. The licensee completed 8 hours of preventative health which included nutrition and lead training on 02/18/2023. Pediatric CPR and First Aid certification expires on 03/2025. Immunization records per SB792 were reviewed and are complete for licensee. Required documents were posted during the time of inspection.

Licensee and adult residents in the home have criminal record clearances and/or exemptions on file. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

Licensee provided proof of control of property. LPA provided licensee with information from the Child Care Law Center which provides information regarding renter’s rights to operate licensed family childcare homes in rented homes.

On this date, 12/11/2023, the California Attorney General - Megan’s Law website (meganslaw.ca.gov) was searched for information on sex offenders required to register with local law enforcement under California's Megan's Law. No registered sex offenders were found at the facility addresses. Under state law, some registered sex offenders are not subject to public disclosure; therefore, they may not have been included in this search. However, the Department conducts a monthly cross reference of each address on record for all registered sex offenders against all CCLD facility addresses pursuant to information shared by California DOJ.

LPA discussed safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

LPAs observed a man made fountain containing no water, filled with dirt, located in the backyard.

When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. The following information regarding ADA was provided: US Department of Justice (USDOJ) toll-free ADA Information Line at (800) 514-0301 (voice)/ (800) 514-0383 (TTY) and link to publication: Commonly Asked Questions about Child Care Centers and the ADA, available at: http://www.ada.gov/childqanda.htm.

The Provider Resource Packet was reviewed with the applicant including information on the following: PIN 20-24-CCP Safe Sleep Regulations, lead exposure, SIDS, shaken baby, child abuse reporting, community resources, children’s records, facility records, required postings, immunization, unusual incident report, facility roster, car seat law, visual for ratio/capacity, fire/disaster drill log. Applicant was also informed the following items are prohibited during day care operating hours (walkers, exersaucers, jumpers and bouncy seats). Corporal punishment and smoking are not allowed in the day care.

The Licensee states he is financially secure to operate a family childcare home for children. The Licensee agrees to comply with all regulations and laws governing family childcare homes.



Licensee was advised that an agent of the Licensing Department upon presentation of proper identification, may enter and inspect any place providing personal care, supervision, and services at any time, with or without advance notice. The Applicant shall permit the Department to inspect the family childcare home, and to privately interview children or staff, to determine compliance with or to prevent violations of family childcare laws or regulations. Licensee was advised that the Department shall assess an immediate civil penalty of five hundred dollars ($500) per violation and one hundred dollars ($100) for each day the violation continues after citation, if the Licensee refuses any agent of the licensing Department entry into the daycare or any part of the daycare.

The applicant was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain childcare by connecting them to childcare providers and Resource and Referral Agencies (R&Rs) throughout California.

Community Care Licensing Division (CCLD) regularly sends information to licensed facilities, providers, and stakeholders by way of Provider Information Notices (PIN), Program Quarterly Update Newsletters and other important information communication platforms. LPA review the ratio/capacity worksheet with licensee. LPA discussed the maximum capacity for a small family child care home: four infants only (infants mean any children under 24 months); or six children with no more than three infants; or, with landlord consent, eight children with no more than two infants, one child in kindergarten or elementary school and one child at least age six, including children under age 10 who live in the home. Property Owner/Landlord Consent form LIC 9149 is on file.
