Personal Rights: Staff used inappropriate form of punishment

On 04/13/2023 at 10:30 a.m., Licensing Program Analyst (LPA) Beneroso conducted an unannounced subsequent investigation to deliver the findings for the above allegation. LPA met with Director, Giovanni Aragon who guided LPA on a tour of the facility. Upon LPA's arrival, there were 53 children in care observed with 8 staff members providing care and supervision.

The investigation consisted of interviews with staff, children, children's parents, review of facility roster and other pertaining documents related to the complaint investigation. During interviews conducted, Staff #1, Staff #2 and Staff #3 disclosed when children misbehave, they use redirection techniques and encourage dialog with children when they face challenging behaviors. Staff #1, Staff #2, and Staff #3 denied that on 01/25/23 during lunch time, they instructed children to put their heads down on the tables and not to talk to anyone as a form of discipline. Children did not disclose the alleged incident occurred and on the contrary, they provided statements that they like Staff #1, #2, and #3. Children disclosed when they do something that they are not supposed to do, staff members talk to them to reflect on their actions.

Based on the information obtained, there were no disclosures or witnesses that could corroborate the above allegation occurred; therefore, the allegation is deemed to be unsubstantiated. Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred.
