On 07/26/2023, An unannounced complaint inspection was conducted today by Licensing Program Analyst (LPA), Jose Penate. LPA met with Director, Amy Miller. LPA advised the purpose of today's inspection is to close the complaint investigation. During investigation, LPA interviewed staff, interviews children’s representatives, reviewed facility records, and observations made by LPA.

With the allegations of, Staff handle day care children in a rough manner, Staff yell at day care children, and Staff restrain day care children on nap mats have been investigated and based off of interviews and LPA observations conducted these incidents did in fact occur at the facility.

After conducting interviews, information gathered that staff are not properly redirecting children at the facility, whether that be by verbal redirection or physical. Staff have violated the Personal Rights of children in care and have not been given the proper redirection that is necessary at the facility. This resulted in the children being handled in a rough manner and also staff yelling at the children while in care. This is a violation of the Personal Rights of children in care.

After conducting interviews, information was gathered that staff have restrained a child/ren in care whether it be by holding the child down and that they remain on their sleeping mat so that they do not wake up the other children in care and also staff have physically restrained a child by placing their leg/s over the child while on his/her sleep mat so that they do not get up from the mat. This is a violation of the Personal Right of children in care.

This agency has investigated the complaint with the 3 allegations. After interviews and LPA observations this agency has investigated the above complaint allegations and the preponderance of evidence standard has been met; therefore, the above allegation is found to be SUBSTANTIATED.

Per California Code of Regulations, Title 22, Division 12, the following deficiency is being cited on the attached LIC9099-D, see next page.
