13 | On 01/22/2024, Licensing Program Analyst (LPA) Beneroso conducted an unannounced complaint inspection to deliver findings on the above allegations. LPA met with licensee, Marilu Garza and toured the facility. Upon arrival LPA observed 1 child and two adults proving care and supervision.
During the course of the investigation, LPA conducted interviews with parents, children, school representatives and licensee. LPA gathered relevant information related to the complaint. The evidence gathered revealed the following:
Allegation One: Based on the interviews and record review with the school, there was not enough evidence to corroborate that licensee sent child #1 to school with inappropriate clothing on or around October 17th, 2023. Allegation Two and Three: From interviews conducted, it was concluded that licensee did not threaten day care child #3 with a spanking on or around July 3, 2023, and licensee did not hit day care child causing injury on or about September 8, 2023. Allegation Four: Based on interviews and record reviews, there was no corroboration that licensee did not follow day care child's medical instructions for milk consumption.
Based on information obtained, observations, interviews conducted, relevant information received, this allegation is deemed UNSUBSTANTIATED. Both allegations for personal rights have been deemed Unsubstantiated meaning, the allegation may have happened or are valid, but there is not a preponderance of evidence to prove or disprove that the alleged violation occurred.
Exit Interview was conducted and A copy of this report, Notice of Site visit, and Appeal Rights were discussed and left with licensee Garza at the facility.
