On 08/18/2021 Licensing Program Analysts (LPAs) Araceli Gibson and Rene Mancinas, conducted an unannounced complaint inspection to provide findings regarding the above allegation. LPAs attempted to meet with Licensee, Candice Morris-Mossman. The purpose of the inspection was to discuss the above allegation and findings with licensee. LPAs were unsuccessful in reviewing and providing a copy of this report with Licensee.

During the course of the investigation, LPA Gibson inspected areas accessible to children in care, interviewed staff, children, and parents, and reviewed facility records. Investigation revealed the following:
During inspection of the backyard, which is an area accessible to children in care, LPA Gibson observed several items that could potentially pose a threat to health, safety, and personal rights of children in care. LPA Gibson observed large rocks, shovel, an uncovered propane tank, and potholes.

Based on the above observations the preponderance of evidence standard has been met, therefore the allegation that ‘Hazardous items accessible to day care children’ is SUBSTANTIATED. (Continued on 9099-C)

LPAs attempted to meet with Licensee, Candice Morris-Mossman. The purpose of the inspection was to discuss the above allegations and findings with licensee. LPAs were unsuccessful in reviewing and providing a copy of this report with Licensee.

During the course of the investigation, LPA Gibson inspected areas accessible to children in care, interviewed staff, children, and parents, and reviewed facility records. Investigation revealed the following:

Allegation 1: Licensee understands children are to never be left alone unsupervised. Investigation did not reveal concerns that children are being left alone at the facility without appropriate supervision.

Allegation 2: Investigation did not reveal concerns that children are engaging in inappropriate behaviors, including throwing rocks.

Allegation 3: Investigation did not reveal concerns that facility yard is dirty, or that trash is not being contained appropriately.

Allegation 4: Although the facility has a door that had damage to it, the door is located in an area inaccessible to children.

Based on the above investigation findings, and although the above allegations may have occurred and/or are valid, the preponderance of evidence standard was not met. Therefore, the above allegations are UNSUBSTANTIATED.

Per California Code of Regulations Title 22 Division 12 Chapter 3, no deficiency is being cited.

This report shall be made available to the public upon request. LIC 9213 Notice of Site Visit is required to be posted for 30 days.
