32 | Based on information obtained by interviews, and through report review, it was revealed that firearms and ammunition were not locked and stored securely or separately and that the firearms were located in a closet inside an accessible upstairs bedroom where the door to the room was open and unlocked.
During the course of the investigation, it was discovered that an adult resident in the home was not authorized to possess firearms, stored firearms in the home, and did not surrender the firearms as requested by law enforcement. Licensee stated in an interview with LPA, that they had no knowledge of the firearms being inside the home, however based on information obtained by other interviews, document review, and statements provided to law enforcement it was determined that the Licensee did indeed have knowledge of some of the firearms stored inside the home. It has been determined that Licensee provided statements that were inconsistent and contradicting.
Based on review of the investigation report provided by law enforcement, the preponderance of evidence has been met, that the behavior of an adult in the home poses a risk to day care children, that Licensee did not ensure firearms were properly stored, and that Licensee did not ensure ammunition was properly stored. Therefore, the above allegations are found to be SUBSTANTIATED.
Per Title 22 Division 12 Chapter 3 of the California Code of Regulations the following deficiencies are being cited (see attached pages) and a Civil Penalty of $500.00 has been assessed for accessible firearms and ammunition.
LPA Burnias informed licensee Candice Morris-Mossman that this report dated 05/30/2025 documents two Type A citations which shall be posted for 30 consecutive days as there are immediate risk(s) to the health, safety, or personal rights of children in care. Also, LPA Burnias informed the licensee to provide a copy of this licensing report dated 05/30/2025 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
Licensee was provided appeal rights. This report shall be made available to the public upon request. LIC 9213 Notice of Site Visit is provided and required to be posted for 30 days. |
