On May 9, 2024, Licensing Program Analyst (LPA) Paul Garcia, conducted an unannounced required inspection for the preschool license. LPA met with Eva Uibarri and toured the facility indoors and outdoors. Days and hours of operation are Monday through Friday 7:30am to 4:30pm.

Assembly Bill 2370, Chapter 676, Statutes of 2018 requires all Child Care Centers (CCCs) that are located in buildings constructed before January 1, 2010, to test their drinking water for lead contamination by January 1, 2023, and every 5 years thereafter. This facility does not use any water outlets for drinking water or food preparation.

There is no swimming pool or other bodies of water on the premises. There are no firearms or ammunition allowed or stored on the premises. Disinfectants, cleaning solutions, medication and other hazardous items are made inaccessible. No poisons were observed during the inspection.

Furniture and equipment are in good condition, free of sharp, loose or pointed parts. Eva stated preschool children do not currently use the playground structure and swings, but do use the grass areas with during separate scheduled times than kindergarten children. LPA verified that there is an existing waiver that was granted on June 4, 2004 allowing the outdoor gated play yard to be used by preschool children. The preschool also utilizes the shaded patio area for outdoor play. Playground equipment is in serviceable condition, free of sharp, loose or pointed parts. The surface of the outdoor activity space is maintained in a safe condition and is free of hazards. All toilets and hand washing facilities are in safe and sanitary operating condition. Floors in the facility are clean and safe. This facility does not provide any food to the children however parents provide their own children lunch daily. Solid waste storage containers have tight-fitting covers and are in good repair. Drinking water is available both indoors and outdoors. The facility is free of flies, insects and rodents. Facility has one or more functioning carbon monoxide/smoke detectors that meet statutory requirements. Continued on LIC809-C

During today’s inspection, there was an uncleared adult who was observed in the licensed preschool area. LPA received confirmation that she was a Preschool Aide and records reviewed indicate that she has been employed since April 7, 2022. The uncleared adult was instructed to leave the premises.

Also present and observed providing care and supervision was a Preschool Teacher that has department clearance for a facility located in Orange County but is not associated to the facility inspected on this day. Records reviewed indicate she has been employed for license # 163808092 since August 8, 2023. This staff member was allowed to remain on grounds to continue to provide care and supervision to the preschool children.

Facility representative was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated

Capacity and limitations as specified on the license are being maintained. At least one person trained in CPR and Pediatric First Aid is present when children are at the facility or at offsite activities. The name of the child care center director or fully-qualified teacher(s) designated to act in the director’s absence has been reported to the Department. This facility uses FACTS Management digital software that tracks children entering and departing from the facility. Each parent or authorized representative is assigned and provided a unique code that records the day and time of attendance. The person who signs the child in/out of the facility shall use their full legal signature and record the time of day. All children are under supervision, including visual supervision, of a teacher at all times. Facility maintains a ratio of one teacher supervising no more than 12 children in care. LPA reviewed a sample of children’s files and observed files were complete with contact information for authorized representative and or relatives or others who can assume responsibility for the child and medical assessment. LPA reviewed a sample of staff files and observed files were complete with health screening, immunization records for influenza, pertussis and measles and current documentation of completed mandated reporter training.

LPA and Licensee discussed the Community Care Licensing website www.ccld.ca.gov which will provide access to Provider Information Notices (PINs), Quarterly Updates, COVID-19 Information and Resources, Mandated Reporter Training, Safe Sleep in Child Care, Lead Poisoning Facts, Forms and Regulations.

facility representative was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

Per Title 22, Division 12, Chapter 1, of the California Code of Regulations, the following deficiencies are being cited: (see next page, LIC809-D)

Upon receipt of a type A violation, the licensee shall post and provide copies of this licensing report to parents/guardians of the children in care at the facility and to parents/guardians of children newly enrolled at the facility during the next 12 months. A copy of the Fact Sheet - Child Care Parent Notification Requirements and a copy of LIC 9224 was given to the licensee.

An exit interview was conducted, and this report was reviewed with facility representative Eva Uibarri.

Notice of site visit was issued and must remain posted for 30 days.

Appeal Rights were discussed and issued.
