On 2/25/2022, Licensing Program Analyst (LPA) Ocegueda conducted a case management inspection at Licensee’s request. Licensee requested that LPA Ocegueda inspect new play structures and an area in her back yard where she would like to possibly add a water pond. LPA met with licensee Maria Garza. Before entering, LPA Ocegueda conducted a Covid-19 safety screening. LPA toured the facility and took a census.

Today, LPA Ocegueda first inspected the swing set play structure. Per licensee, the play structure was obtained brand new. The play structure is made of wood and sits on new green artificial turf. There was shading that was added that covered the entire structure. LPA observed that the poles that held the shade were padded. The play structure was anchored to the ground and no wood splintering was observed. There were two bolts holding a hanging ball on the bottom of the structure that were protruding approximately 1.5 inches. LPA recommended that the bolts be covered with bolt protectors as an extra safety measure and provided licensee with an example of the kind of products available to help protect the bolts. Licensee stated she will be placing protective bolt covers.

Licensee also requested that LPA Ocegueda inspect a playhouse that was constructed by licensees’ husband. The play house was made out of wood, has two windows that open and two separate doors. The doors have the capacity to remain closed as they have a small wood block that swivel over the door. The inside of the play structure has age appropriate toys and equipment. Licensee stated that her husband will be sanding the inside of house before use and sealing the wood to prevent splintering. Licensee stated she does not plan to use the house until it is properly sanded on the inside and sealed. LPA also suggested that licensee be mindful of using the playhouse in hot weather as it could be possible for heat to be trapped inside. LPA also reminded licensee of the requirement for proper care and supervision while the children were inside the play structure as it could create blind spots that could block licensees view. Licensee stated she would be observing and ensure children were properly supervised as required while using the play structure. Licensee stated she understood. Report continued to 809-C

Licensee also enquired about a pond she would like to possibly add to a part of her yard that is currently off limits. The area was observed by LPA. Per licensee, the pond would be oval in shape and would be approximately 15-20 feet in length by approximately 15 feet in width. The home has multiple doors and windows that currently face the area where the pond might be built. LPA reviewed the regulations involving bodies of water and indicated to licensee that there should be no windows or doors openly facing bodies of water. LPA reviewed the fence requirements in detail from the regulation. Licensee stated that due to having young children in care and young family members, she had planned to gate off the pond. Licensee will inform the Department if she decides to move forward with building a pond.

Today, LPA Ocegueda approved the wooden play structure for use. Licensee stated she will not be using the playhouse until it is sanded and the wood is sealed and that she would monitor use during warm weather and follow supervision requirements. Licensee stated she is unsure if she will build a pond but stated she understood the regulation requirements and would inform the Department if she wished to move forward with building the pond.

Per Chapter 3, Division 12, Title 22 of the California Code of Regulations no deficiencies are observed today.
