Licensing Program Analyst (LPA) Leticia Rosales-Meza conducted a subsequent complaint tele-investigation video conference with Herlinda Hernadez, Licensee for the purpose of delivering complaint investigation findings. Due to COVID-19, the Department has suspended field operations, and Licensee has agreed to attend a FaceTime video
tele-inspection in place of an in-person, site visit. It has been alleged that Licensee mistreats daycare children while in care, specifically that the Licensee verbally abuses Child 1 (C1) and Child 2 (C2) by calling them names. It has been alleged that Licensee inappropriately pulls a child's hair while in care, specifically that Licensee pulls the C1's hair. It has been alleged that Licensee allows children to be called inappropriate names while in care, specifically that Licensee has a son who lives with her and he also calls the children names.

During the initial investigation an interview was conducted with Licensee on 11/19/20 at 04:00 PM. The Licensee denied the allegations. Licensee stated that she's never mistreated a day care child. Licensee stated that she always treats all the day care children with respect and dignity. Licensee stated that she's never pulled C1's hair, or any of the children's hair inappropriately. Licensee stated there are times when she has assisted or comb a child's hair, especially the ones who are drop off very early and then leave her day care to go to school.

Licensee stated that she does not allow the children to be called inappropriate names. Licensee stated that there are some children who are older and tend to want to call another child names, but she talks to the child, that it's not nice and we should all speak to each other appropriately and respect one another. Licensee stated that her son never calls the children's names. Licensee stated that she provides good quality care for all her day care children. Licensee stated that when the parents come and pick up their children they don't want to leave her day care.


An interview was conducted with Staff 1 (S1) on 4/07/21 at 4:40 PM. An Interview was conducted with Parent 1 (P1) on 4/05/21 at 5:30 PM. An Interview was conducted with Adult 1 (A1) on 4/05/21 at 6:04 PM.

During the tele-inspections, the LPA did not observe any of the children being mistreated. LPA observed Licensee and assistant, spouse supervising all the day care children in a large play room and the children seemed real happy. Licensee was giving the day care children a lot of her attention.

Based on interviews conducted and records reviewed, although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that the alleged violation occurred, therefore the allegation is Unsubstantiated.


LS’s signature was not recorded on this Complaint Investigation Report (CIR), however, this report was reviewed and discussed with LS, LS was provided with a copy of this CIR; and Appeal Rights, LS’s signature will be on file. All licensing reports are public information and must be made available upon request for at least three years.

There were no Title 22 deficiencies cited during today's video inspection.
