A subsequent complaint investigation visit was conducted today by Licensing Program Analyst (LPA), Sebastian Phouthavong who met with Director, Krystal Gomez regarding the above allegations. LPA previously conducted an inspection on 02/21/2024 to initiate the investigation and met with Director to discuss the allegation, conduct interview(s), make observations, and request documents.

It is alleged that staff did not prevent daycare child from being injured specifically a child sustaining multiple injuries. Also, it is alleged that staff do not adequately supervise day care children specifically that properly supervision is not being provided to the children when outdoor. Finally, its alleged that staff are commingling day care children specifically that the infant children are playing together with the preschool children when outside on the playground.

During the course of the investigation, LPA conducted interviews with the Director (D1), Licensee (L1), 2 Staff (S1 & S2), 4 children (C2-C5) & 4 Parents (P1-P3) from 02/21/2024 to 04/11/2024.

D1 and L1 denied the allegations. D1 and L1 stated on the alleged dates, staff did not observe any incidents where C1 sustained major injuries. D1 and L1 further stated that C1 was being closely monitored and wellness checks were conducted. D1 claimed that C1 did sustained a minor injury from a fall but did not show signs of distressed. In addition, interviews from D1 and Staff (S1 & S2) indicated that the daycare children are reminded to not run indoors and if misbehaving would use redirection or time out until they calm down.

D1 and L1 stated the facility’s ratio is not more than 8 children to one staff, with Community Care Licensing requirements being that there shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance. Statements from D1, L1 and Staff (S1 & S2) indicated when outdoors at least 2 teachers are supervising at opposite ends to ensure every child is being observed. Additionally, S2 stated that the children are never left alone. D1, L1 Staff (S1 & S2) stated the two licenses are divided by age and never commingle. Furthermore D1, L1 and S1 stated when the preschool children are led to the outdoor area by at least 2 staff, the children do go through the Infant license’s playground, but is done when the infants are not present. Also, D1 and S1 stated they understand that the facility is licensed for children ages two to six years old but do have children that can appear to be under age requirements. Interviews conducted by parents and children had no concerns with the allegations filed against the facility. It could not be confirmed if C1 sustained major injuries while at the facility.

Based on the information gathered during this investigation, although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that the allegations occurred and therefore are determined to be unsubstantiated. There were no Title 22 deficiencies cited. This report was reviewed and discussed with the Director, Krystal Gomez. Appeal rights were provided. Notice of Site Visit shall be posted for 30 days from today's visit.
