On September 3, 2021 at 10:30 AM Licensing Program Analyst, Laura Villanueva conducted an unannounced inspection to initiate a complaint investigation. Prior to inspection, LPA Villanueva asked pre screening questions related to COVID 19, Director's response indicates there are no COVID 19 exposures on site. LPA toured the 5 classrooms and enclosed yard with Director, Julie-Ann Bruskrud. There are 13 staff present with 75 children in attendance. The school is an outdoor classroom school, so the children spend time working indooes as well as outdoors. The outdoor area offers the children many options to explore. LPA obtained a copy of the email correspondence sent to parents regarding COVID-19 policies and mask wearing. The verbage used: "Masks: It is a state public order that masks will be required indoors for children over 24 months as well as for staff/adults regardless of vaccination status. We cannot force your child to wear a mask at all times but we will be very diligent in encouraging mask usage." Parents respond to COVID-19 related questions when they sign their child in for the day and their temperature is taken . Parents drive up to drop off their child while a Teacher waits at a desinated gate for her students. LPA observed staff wearing masks indoors and some children wearing masks indoors. classroom, the children have the option of not wearing a mask. Children are encouraged to wear masks when they work in the classroom. Children must have masks available to them in their backpacks. LPA reminded Director the staff should encourage children to wear masks throughout their daily activities. LPA also advised that Child care providers must ensure compliance with the current CDPH Guidance for the Use of Masks. As of June 15, 2021, the use of face coverings is required by the California Department of Public Health (CDPH) and the Division of Occupational Safety and Health (Cal/OSHA) in child care indoor settings regardless of vaccination status. LPA issued a Technical Advisory and advised Site Supervisor that facility should continue to follow COVID-19 requirements and guidance in all applicable California Department of Social Services (CDSS) and Community Care Licensing (CCL) Provider Information Notices (PIN), in addition to guidance or requirements from California Department of Public Health (CDPH)California Department of Industrial Relations Division of Occupational Safety & Health (Cal/OSHA), and local public health departments, as applicable to the particular facility.

This agency has investigated the complain alleging " Children are not wearing a mask in class " Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED.
