Licensing Program Analyst (LPA) Shushanik Safaryan conducted an unannounced inspection to deliver complaint findings. Upon arrival, LPA met with the Facility Representative, Ellen Veselack, to whom the reason for the visit was explained. A tour was provided, and the census was taken. There were 98 children present with 28 staff members.

The complaint alleged that staff restrained a child.
During the investigation, the Licensing Program Analyst (LPA) interviewed the Director, nine staff members, six children, three parents, and an Occupational Therapist present at the school.

Per the Occupational therapist, they help C1 with social skills and behavior.
During the investigation, it was disclosed that C1 will scream, push, and throw toys if frustrated. During the interviews were disclosed that C1 did not have an assigned staff member to assist during the nap time. Interviews conducted revealed that three staff members witnessed S3 with both their legs on top of C1 during nap time. Page 2 of 1

Staff also disclosed that C1 appeared was not ready to stay on his mat and was visually frustrated . Per staff members it lasted about 15 to 30 minutes .Three children stated that they heard C1 crying during the nap time. S3 admitted to using her leg on C1 and stated that they observed S5 doing the same to C1. S3 stated that they used their leg to provide more sensory input, as C1, according to P1, responds well to pressure on his body for regulation. However, S3 also admitted that she did not have training for sensory input or deep pressure. There was no agreement or plan on file that staff should place their legs on top of C1 to apply deep pressure for sensory input. Per Director, the facility did not provide any training for providing sensory input or deep pressure and the staff confirmed.
Two staff members disclosed that they also have observed S3 putting their legs on C6 during nap time. Another staff member reported that S5 put her legs on C5 and C1. S5 admitted to putting their leg on C1 and stated that they had observed another staff member putting their legs on another child during nap time. S 5 also admitted that she did not have training for sensory input or deep pressure.
Parents for C5 and C6 disclosed that staff never discussed utilizing any other methods if children don’t nap. Per parents when a child refuses to nap, staff members will take them outside to play. Two staff members disclosed C1 recently moved to their class . During the nap C1 either will stay on his mat or play outside if not ready to sleep and no additional techniques utilized.

Based on interviews which were conducted and record review(s), the preponderance of evidence standard has been met, therefore the above allegation(s) is found to be SUBSTANTIATED. California Code of Regulations, (Title 22, Division 12 & Chapter 1), are being cited on the attached LIC 9099D.

Licensing staff informed Facility Representative a copy of this licensing report dated 09/19/24 that documents any Type A citation(s) need to provide to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
An exit interview was conducted with Facility Representative, Ellen Veselack and Appeal Rights explained.

The Notice of Site Visit (LIC 9213) – must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to maintain posting as required will result in a civil penalty of $100.00.

Staff need to conduct training with the staff members regarding children`s personal Right`s in Childcare .
