On 03/07/2023 at 10:00 a.m., Licensing Program Analyst (LPA) Carolyn Tuba conducted an unannounced complaint inspection and to deliver findings of the above allegations. A Covid risk assessment was conducted when entering the facility. LPA met with Director, Patricia Uba, who guided LPA on a tour of the facility. There was a total of 9 children present with 2 staff.

Complainant alleged that staff did not meet day care child’s needs. Day care child’s needs were not met, as the reporting party (RP) stated that wood chips were found in Child #1 (C1) diaper. Per RP the exact date of when wood chips were observed in C1’s diaper was unknown. LPA conducted interviews with Staff #1 (S1), #2 (S2), and #3 (S3). Staff #4 (S4) was not available to interview at this time. Children were currently too young to interview. During the interviews staff did state that occasionally children who are potty training and wear pull-ups, which at this time are 5 to 6 children in care occasionally have been found with wood chips, but it is rare, but if wood chips are discovered then children are immediately changed. S1 and S2 stated that they keep a diaper schedule to check and change the children. S1 and S2 state that they make visual observations, as well as ask children if they need to be changed before

and after transition times through-out the day or as needed. Director states that once children are verbal about bathroom needs, they begin training children to use the restroom. LPA did observe that the outside playground, where the children play, does have wood chips.

Therefore, the allegation has been determined to be unsubstantiated. Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred.

LPA issued a Technical Violation on this day and explained to Director to have staff check inside of diapers for wood chips after outside time and supervise when children are playing in those areas. While it did not cause any serious injury, however it has the potential to cause injury in their genital areas due to the material is made out of wood.

The Notice of Site Visit (LIC 9213) must remain posted for 30 days during the hours of operation after each site visit by a licensing representative. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Exit interview was conducted and appeal rights, along with a copy of this report were given to Director, Patricia Uba.
